Michigan Artificial Intelligence Prohibition Act
The Issue
The purpose of this Act is to prohibit the development, deployment, operation, and commercial or governmental use of artificial intelligence systems within the State of Michigan, in order to protect public safety, individual autonomy, employment, privacy, and democratic integrity.
Section 3. Definitions
For the purposes of this Act:
“Artificial Intelligence” or “AI” means any machine-based system, software, algorithm, model, or computational process that performs tasks, makes decisions, generates content, or produces outputs that would ordinarily require human intelligence, reasoning, judgment, or creativity.
“Autonomous System” means any device, machine, vehicle, aircraft, robot, drone, or software capable of operating, navigating, or making decisions without continuous human control.
“AI-Driven Device” means any product, machine, vehicle, aircraft, robot, drone, or software that incorporates artificial intelligence or autonomous system capabilities.
“Chatbot” means any interactive software system that generates text, speech, or conversational responses using artificial intelligence.
“Plugin, Extension, or Embedded Tool” means any software component, website feature, or digital service that uses artificial intelligence to perform or enhance functionality.
“Human-Controlled Operation” means operation in which a human being directly performs all decision-making, navigation, control, and judgment in real time.
Section 4. Prohibited Activities
The following activities shall be unlawful within the State of Michigan:
Operation of AI-Driven Vehicles and Aircraft
No person, business, or governmental entity shall operate, deploy, sell, or permit the use of:
autonomous or AI-driven cars, trucks, buses, or other motor vehicles
autonomous or AI-driven aircraft, including drones
autonomous or AI-driven watercraft
Use of AI-Driven Robots
No AI-driven robots, robotic systems, or automated machinery capable of independent decision-making or autonomous operation may be manufactured, sold, deployed, or operated within the state.
Use of AI Chatbots
No business, organization, or governmental entity may deploy, host, or provide access to chatbots or conversational systems that utilize artificial intelligence.
AI-Enabled Website Tools
No website, application, or digital service operating in Michigan may use AI-based plugins, extensions, or embedded tools unless a fully non-AI alternative is provided and set as the default option.
Government Use
No state or local government agency may procure, deploy, or utilize artificial intelligence systems for any purpose, including but not limited to law enforcement, administrative decision-making, public services, or data analysis.
Section 5. Requirements for Alternatives
Any service, product, or digital tool previously reliant on artificial intelligence must provide a human-operated, non-AI alternative that performs the same essential function without the use of artificial intelligence.
Section 6. Enforcement and Penalties
The State of Michigan shall establish an enforcement body or designate an existing agency to oversee compliance with this Act.
Violations may result in:
civil fines
revocation of business licenses
prohibition from operating within the state
Each day of noncompliance shall constitute a separate violation.
Section 7. Exemptions
The Legislature may establish narrow exemptions for:
academic research conducted in controlled, non-public environments
medical devices that do not perform autonomous decision-making
technologies required for federal compliance where state prohibition is preempted
Section 8. Severability
If any provision of this Act is found unconstitutional or invalid, the remaining provisions shall remain in full force and effect.
Section 9. Effective Date
This Act shall take effect one year after voter approval.
