Help Disabled Low Income Parents with Child Support Arrears

The Issue

“Nationwide, the bulk of people who owe child support are low-income fathers who lack the capacity to pay. Their ever-growing debt can wind up serving no one well — including the children those payments are intended to help.” (Boston Globe, July 20th, 2015). This article, like many articles on the subject continues to explain why child support orders for low income disabled parents hurts everyone. Interest cost should be waived for disabled low income parents. “With interest… by the end of a year, a parent could be paying an interest rate of 12 percent — more, advocates note, than the best stock market investments are likely to yield. Continued nonpayment can lead to larger consequences: driver license suspension, or jail time on charges of civil contempt. These policies, designed to motivate, can make it increasingly difficult for parents to hold jobs, leading to even more debt.” This is especially wrong in cases where the parent is disabled. In one Minnesota case a father, Dan, experienced those situations and penalties. He had a spinal cord injury, but with effort and healing he was able to walk again. Then, he had cancer, and after 36 rounds of chemotherapy, and multiple surgeries he owes approximately $100,000 in child support. This person has 1 child. He struggled to make payments because of his health challenges and unable to stay employed because of his health issues. His child is over 21 and the child support offices in Dakota County denied him modifications over and over. Approximately $60,000 of this debt is interest. Dan struggles to live on $600 a month from SSDI. Child support takes $550 away from him to pay past arrears. He has talked to child support and they have told him there is nothing he can do. He will never own a home, or be able to buy a new car with a judgement of past arears of $100,000. He cant afford a lawyer to help him and he is told by child support there is nothing he can do to change his situation. He cant barely pay for his own needs. Please make a change in the child support laws for disabled and low income parents to at least erase or forgive past interest rate charges.
