Strategy Amended I made a mistake. In the previous update, I wrote that the developer had submitted the application to rezone the entire site, but to build only the first duplex in a seeming attempt to minimize the community's concerns and gain rezoning approval. In fact, the application IS for only the first duplex, but NOT to rezone (yet). The duplex can be built using the land's current zoning. Here's The Kicker Rezoning or building more than 5 units requires the standard review process, which includes a neighborhood meeting and two public hearings (Planning Commission and City Council). However, by dividing the project into Filing No. 1 (duplex) and No. 2 (rezoning and 24 townhouses), the builder is being allowed a simplified review process for the duplex, which excludes all public review, as well as reviews by Planning Commission and City Council. This simplified review happens within the Community Development Department, whose own director approves or denies the application. Loophole? I believe so. The simplified review process has its place, but is not intended to divide larger projects into pieces, thus allowing part of the project to avoid the review of key stakeholders. This split filing can cause significant problems downstream. I emailed the Director of Community Development Rita McConnell, cc: Mark McGoff, regarding this.
