
In a recent filing in court, Frank's attorneys demonstrated that the paint which was found on the bumper of his car and which was “proved” to be from the victim’s bicycle, was never supported by adequate laboratory testing.
To obtain further categorical evidence of this lack of any connection, Frank's attorneys sought to have the crime scene evidence sent for testing, an effort supported by an internationally acclaimed laboratory's (Microtrace) senior researcher, Dr. Christopher S. Palenik. Major flaws in governmental testing of the evidence were revealed and an explanation was given on how the further scientific examination would unequivocally prove that Frank’s car never had contact with the victim’s bicycle.
DR. PALENIK'S REPORT
Details of Dr. Palenik's findings included:
- Necessary government documents were not completed, or were unsigned.
- Extremely limited analytical details on data and testing were provided.
- Failure to document who collected samples and from where they were collected.
- Not accounting for significant elemental differences between bike and bumper smear paints.
- Testing in such rudimentary and negligent manners so as to condemn the results as having any true value.
The main conclusion was that the elemental differences between the paints was sufficient to eliminate the bicycle as the source of the paint smear which was found on the bumper of Frank’s vehicle - the only alleged proof that sealed Frank’s conviction.
Unfortunately, with pressure from the Attorney General’s office, the AZ courts have refused to allow this critical testing! Frank’s attorney’s are now appealing to the AZ State Supreme Court.
FRANK WOULD HAVE BEEN EXECUTED TODAY
Today was the planned execution date for Frank. By a miracle, issues surfaced regarding the shelf-life of the lethal injection drug, which have caused Frank's execution to be postponed. In the meantime, the Attorney General’s office is engaging in drug (Pentobarbital) testing in order to ensure that they can procure a batch of drugs which have a longer shelf-life. It is likely that they will find a way soon to procure the drugs they need, since they are lusting to put Frank to death as soon as possible.
What is even more sad is the fact that Frank Atwood and AZ Attorney General Mark Brnovich both belong to the same Orthodox Christian Church, which would never condone Mark to put Frank to death, especially if there is reason to believe he may be innocent. But considering that AG Brnovich is running for Senate and it is in his political interest to execute Frank, he has turned a deaf ear to the entreaties of others to reconsider the evidence, even after talking to Frank’s priest.
YOUR HELP NEEDED!
If enough people take the time to contact Mark Brnovich’s church pastor and/or the Bishop of his church, they may be able to plead with him to stop the madness and allow the evidence to be re-examined. After all, if Frank is innocent, then Brnovich certainly wouldn’t want him to be put to death, right??
