Mandate Pre-Trial Detention for DUI Offenders Involved in Fatal Accidents
The Issue
My son, Aidan, was tragically taken from us in February. He was struck by a drunk driver who was heavily intoxicated and driving a large truck with a horse trailer at 6:00 pm on a Wednesday. Aidan had just finished work and was responsibly riding his motorcycle under the speed limit, wearing his helmet. His toxicology report came back clean. Yet the man who killed him is still free today. He has spent every day free since he took away the most precious thing in the world to me, my family and Aidan's friends. Every day for us has been a living hell, amplified by the fact that the man who took my baby from this world is spending his holidays with his family and doing what he loves every day after taking that away from an innocent person who tirelessly worked on himself and his life to be a positive force in this world.
This is not just our family's story; it's an all-too-common narrative across Arizona and beyond. According to the National Highway Traffic Safety Administration (NHTSA), in 2018 alone, over 10,500 people died due to drunk-driving crashes nationwide - that's approximately one death every 50 minutes. I have spoken to or read stories of hundreds of MADD families who have the same horror story and are waiting years to see these killers in custody. My son's killer is living free in another state while the state of Arizona has been telling us for 6 months that they are filing new charges. I have lost everything and nothing will bring my baby back, but why should a killer be loose on the streets given the opportunity to do this to someone else's loved one?
We are calling for legislation requiring anyone involved in an accident resulting in death while under the influence of drugs or alcohol to remain detained until their trial if the victim was not under influence and abiding by law. Help me prevent this from happening to your family.
Our plea is simple but powerful: If you cause a fatal accident while impaired, you should not be free while awaiting trial. This change will ensure that those responsible for such devastating actions face immediate consequences and cannot continue living their lives as if nothing happened. The person who killed Aidan was visibly intoxicated and continued to be served at 2 different bars after his friends told him not to drive. We have to stop this!
