Mandate Florida to Recognize Paternal Rights of Fathers Listed on Birth Certificates

The Issue

I am a father who has experienced the heartbreak of having my son taken away from me by his birth mother. She did not want to be a mother when we decided to separate, and out of spite, she moved states away with our child. This happened just as we were about to civilly discuss our parenting plan. Due to Florida's current laws, I was unable to retrieve my son and bring him home because the state does not recognize a father listed on the birth certificate as a legal parent in court.

This is not just my story; it's an issue that affects many fathers in Florida. According to the National Parents Organization, only 17% of custodial parents are fathers (U.S Census Bureau). This statistic is alarming considering that studies have shown children fare better when both parents are involved in their lives (American Psychological Association).

Florida’s current laws do not adequately protect paternal rights, especially for fathers who are willing and able to care for their children but find themselves at a disadvantage due merely to their gender or marital status at the time of birth.
