Mandate Compliance of Climate Pledge Arena with the ADA and Allergy-Safe Food Availability

The Issue

I, alongside many others, frequent Climate Pledge Arena with great enthusiasm for the entertainment it provides, primarily Seattle Kraken games, to which I have a season ticket. However, our experiences are significantly hampered by the arena's lack of allergy-safe food options. As someone with numerous serious food allergies, I find it impossible to consume any edibles offered at the venue, fresh-cooked or pre-packaged.  Of the dozens of food stands and numerous fryers, there is not a single one designated as gluten-free. Visitors with celiac disease and gluten allergy cannot safely eat anything fried in the arena without fear of cross-contamination, even if the item itself does not contain gluten. Packaged goods are removed from the manufacturer's packaging and contain no labeling of ingredients or allergens. This repackaging is done under unknown conditions in which cross-contamination might be taking place. 

This lack of transparency not only hinders our ability to fully enjoy our experience but also poses a serious risk to our health. It's important to underline that per the Food Allergen Labeling and Consumer Protection Act of 2004, it is mandatory that food labels clearly identify all ingredients. Also, as stated by the Asthma and Allergy Foundation of America, in the United States approximately 6% of adults and 8% of children have food allergies. For an attendance at a hockey game of 17,000, that's over 1,000 adults and over 1,300 children who cannot eat at the arena. 

The arena's non-compliance with the Americans with Disabilities Act (ADA) is a matter of urgent concern. Title III of the ADA requires that public accommodations like Climate Pledge Arena must ensure that individuals with disabilities are not excluded from or denied services due to their disability. This includes provisions for individuals with food allergies.

We ask that Climate Pledge Arena uphold its responsibility towards the health and safety of all its visitors and take immediate steps to comply with the ADA. This involves providing a variety of clear, accurately labeled allergy-safe food options to ensure nobody is put at risk or excluded from enjoying their time at the venue.
