Make the 'Right to Disconnect' legal in India
The Issue
Why are we filing this petition?
We believe that Indian professionals deserve the legal right to disconnect, to reclaim their personal time, and to rediscover the joy of living beyond the confines of work. This is not just about reducing stress and preventing burnout; it's about empowering individuals to live richer, more meaningful lives.
Petition: The Right to Disconnect
We urge the Indian government to implement legislation that protects the right of employees to disconnect from work-related communications outside of designated work hours.
Proposed Legislation
We support the Right to Disconnect Bill, 2018, introduced by Shrimati Supriya Sule, M.P. This bill proposes to establish an Employees' Welfare Authority and confer upon every employee the right to disconnect from work-related telephone calls and emails beyond work hours and on holidays.
Key Provisions of the Bill
Definition of "right to disconnect": The bill defines the right to disconnect as the ability of an employee to refuse to answer work-related calls or emails outside of designated work hours.
Establishment of an Employees' Welfare Authority: The Authority will be responsible for formulating a charter outlining the terms and conditions for negotiations between employees and employers regarding the right to disconnect.
Negotiations between employees and employers: The bill mandates negotiations between individual companies or societies and their employees to establish rules and protocols for out-of-work hours.
Overtime pay: Employees who work during mutually agreed-upon out-of-work hours will be entitled to overtime pay.
Employees' Welfare Committees: Companies and societies will be required to form committees to assist employees in negotiating out-of-work hour terms and conditions.
Penalty for non-compliance: Entities that fail to adhere to the provisions of the bill will be subject to penalties.
Call to Action
We, the undersigned, call upon the Indian government to:
1. Pass the Right to Disconnect Bill, 2018, or introduce similar legislation to protect the rights of employees.
2. Prioritize employee well-being: Recognize the importance of work-life balance and the negative consequences of constant connectivity.
3. Promote a healthy work culture: Encourage employers to adopt policies that support employee well-being and productivity.
4. By signing this petition, you are joining a growing movement to ensure that employees have the right to disconnect from work-related communications outside of work hours, leading to a healthier and more sustainable work environment.
