Make Misconduct in Public Office a Statutory Offence
The Issue
A personal engagement with the law has highlighted a serious issue. I was convicted of 'Misconduct in a Public Office'. Despite the high threshold this offence requires, the case was not discontinued. Just because this offence is open to interpretation, it doesn't mean it should dismiss the scale of proof required. The lack of clear and statutory definition is problematic and pushes for individuals' rights to be compromised.
It's time we advocate for crystal clarity in the law. Misconduct in a Public Office needs to be treated with the rigor it demands, not left ambiguous under the umbrella of common law. Many other criminal offences like fraud or theft have clear statutory definitions and are not open to such arbitrary interpretation. It is high time this one joins the ranks.
According to the Law Commission in UK, there are problems with the current law including "uncertainty about the nature of the duties a public office holder must breach to be liable" (Law Commission, 2016). This demonstrates a nationwide need for this change. The laws we have in place should definitely protect us, not place us in a precarious position due to ambiguous definitions.
Therefore, we demand that the offence of 'Misconduct in a Public Office' be made statutory, with clear definitions and immutable criteria. This is not just about an individual's case - this move will lead towards greater transparency and accountability within our justice system.
