🎯 Main Message
The Friends of Old Hickory Lake (FOHL) argued at the Public hearing Tuesday evening  that the Foxland Harbor Marina project cannot simultaneously satisfy both the City of Gallatin’s approval process and the U.S. Army Corps of Engineers’ lease requirements, because the developer is effectively presenting two different projects.
 
📑 Key Findings
FOIA Investigation:
FOHL submitted a Freedom of Information Act request (Nov. 19, 2024).
The U.S. Army Corps of Engineers responded after 10 months (Sept. 4, 2025).
Findings revealed promises made to the Corps conflict with what the City is considering.
Corps Lease Restrictions:
Limited in scope, years, and uses.
Requires strict adherence to the “Use and Development Plan” and architectural/signage guidelines.
Prohibits residential development and unauthorized occupation (federal law).
Project Discrepancies:
The Corps-approved plan mandates full build-out from the start (186 slips, utilities, parking, fuel, pump-outs, etc.).
The City of Gallatin plan phases construction, removes or delays features, and allows uses not in the Corps’ lease.
Gallatin plan includes: condos, short-term rentals, and multipurpose buildings—none of which appear in Corps documentation.
Corps requires ground-mounted, simple signage; Gallatin approvals don’t fully reflect these rules.
 
🚩 Violations Identified
Condominiums & Rentals:
Violate Section 19(g) of the lease and 36 CFR § 327.22(a), which forbids private residences on Corps land without approval.
Revenue & Rent Issues:
Corps rent is based on a percentage of marina “gross receipts.”
Condo sales wouldn’t generate receipts under this model, meaning reduced federal rent revenue.
Removal of dry dock (by city planners) further reduces rent payments.
 
📝 Why It Matters
The Corps’ intent: Provide public recreational services at reasonable prices without federal expense.
The developer’s intent (per Gallatin plan): Introduce residential, commercial, and phased elements outside the Corps’ approved lease.
Result: Risk of legal violations, reduced federal rent, and non-compliance with federal concession rules.
 
📌 Conclusion
The Foxland Harbor Marina plan presented to Gallatin officials does not match the enforceable lease with the Corps of Engineers. Approving the current city version would create legal, financial, and regulatory conflicts.
