My name is Magdalena Bartoszek, I am Polish activist and human rights advocate for Palestine and Gaza.

 I am deeply involved in analyzing the ongoing Genocide, War Crimes, Crimes against Humanity and Crime of Aggression in Palestine - a situation that can only be described as Genocide.

My campaign on Gaza genocide to the ICC took nearly 3 years now on LinkedIn and this petition is part of this campaign. I sent to the ICC from Poland Ministry of Foreign Affairs and Justice my verified documents such as diploma or criminal clearance record/ birth certificate.

My commitment to this cause has led me to start a campaign on LinkedIn aimed at securing the arrest and prosecution of Benjamin Netanyahu and Yoav Gallant and other officials I reported at the International Criminal Court (ICC).

UN already concluded it is genocide in Gaza.

Israel has committed genocide in the Gaza Strip, UN Commission finds | OHCHR.

Both individuals have been reported by me to the Prosecutor’s Office due to their alleged involvement in these heinous crimes. I reported nearly 40 officials involved in genocide in Gaza with my file at the ICC Prosecutor Office KC Karim Khan.

As genocide is all about the intent - the intent is here. Following words of the Former Prosecutor of ICC Mr Luis Moreno Ocampo "You don't have to kill people to commit genocide - there must be intent".

I documented with my #Genocidal5 at the ICC genocidal intent = dolus specialis coming from the Israeli officials to:

- starve Gaza

- destroy Gaza 

- occupy Gaza

- commit ethnic cleansing/ genocide

- expel Gazan population

I have been submitting through ICC KC Karim Khan Office for ICJ Judge Yuji Iwasawa and for South Africa Mr Cyril Ramaphosa and Parliament of the Republic of South Africa to prove genocide in Gaza.

I exposed with #ICCBonanzaPlan illegal plan to take over Gaza with the US. 

According to the International Law Israel as the occupying force cannot claim the self defence.

Under Article 49 of the IV Geneva Convention civilians in the occupied territories are protected.

Article 49 of the Fourth Geneva Convention (1949) prohibits individual or mass forcible transfers and deportations of protected persons from occupied territory to the occupying power or any other country. It also bans the occupying power from transferring its own civilian population into occupied territory. 

According to Save the Children International and Defence for Children International Palestine - Israel took between 500-1000 Palestinian child hostages every year.

Israel is the only country that has military detention of children - it must be abolished. Palestinian children need legislative protection.

Article 34 of Geneva Convention IV: This article explicitly states that the "taking of hostages is prohibited" against persons protected by the Convention (primarily civilians in the hands of an enemy Power).

According to UNRWA Commissioner-General Philippe Lazzarini, and supported by Save the Children, more than 10 children per day on average have lost one or both legs in Gaza since the conflict began in October 2023.

Gaza is facing as well one of the largest number of orphans in modern history - backed by genocidal speeches towards Gazan children I documented at the ICC KC Karim Khan Prosecutor.

Israel publicly stated intent to commit genocide and this is clear that yes Israel committed genocide in Gaza.

I demand to arrest and prosecute the Israeli war criminals and child killers of Palestinian people - Benjamin Netanyahu and Yoav Gallant and other Israeli officials.

The people mentioned above have showed their genocidal intent.

His recent references to the Bible have long been used by the Israeli far right to justify the killing of Palestinians.

As others quickly pointed out, God commands King Saul in the first Book of Samuel to kill every person in Amalek, a rival nation to ancient Israel. “This is what the Lord Almighty says,” the prophet Samuel tells Saul. “‘I will punish the Amalekites for what they did to Israel when they waylaid them as they came up from Egypt. And this is what Israel is doing - as they have killed more than 30,000 civilians in just 3 months while injuring more than 70,000.

The Government Media Office stated that Israel committed 2512 massacres in 134 days of genocide, raising the number of those murdered and missing to 35,858, the bodies of 28,858 of whom were registered in Gaza's hospitals.

Yoav Gallant said: “I have ordered a complete siege on the Gaza Strip. There will be no electricity, no food, no fuel, everything is closed,” Gallant says following an assessment at the IDF Southern Command in Beersheba.
“We are fighting human animals and we are acting accordingly,” he adds.

This is genocide on the siege on Article IIc of the Genocide Convention

(c) Deliberately inflicting on the group conditions of life calculated to bring about its 
physical destruction in whole or in part;  

Israel created siege since October - no food, no water, no electricity -which means Israeli government since the beginning had intent to destroy the group - in this case in Gaza.

Inflicting conditions unbearable to live Article IIc Genocide Convention - as the former ICC Prosecutor Mr Luis Moreno Ocampo said.

We have genocide on the siege here in Gaza this is for sure - Former Minister of Defence represented the decision of the entire government.

Ursula Von Der Leyen the same crimes but regarding to Russia described as the”acts of pure terror” and ”war crimes”. 

Well she couldn’t say the same about Israel somehow…

He ordered siege on ALL PEOPLE LIVING IN GAZA. He cut all of them from electricity, fuel and food.

Additionally he called them as human animals.

In another video Yoav Gallant said that they will eliminate everything and that Gaza will not come back to what it was before. Everything will be destroyed.

Pure genocidal intent to destroy Gaza = dolus specialis.

And as you can see the entire Gaza is vanished.

Israel has dropped equivalent of Hiroshima atomic bomb on Gaza.

Nearly all home units are destroyed - these are not military targets - Israel with their intelligence can precisely target military objects - they targeted residential areas with intent to destroy as Yoav Gallant said "Gaza will not come back to what was before".

I exposed Hannibal October 7th at the ICC Prosecutor KC Karim Khan Office Magdalena Bartoszek and I sent through ICC to ICJ Judge Yuji Iwasawa.

Israel used Hannibal they killed their own hostages as Yoav Gallant the former Minister of Defence said that Hannibal was tactically given and Mark Regev advisor to Benjamin Netanyahu said that Hamas bodies were terribly burned among Israeli ones - only Israel has weapons of mass destruction = as bodies were charred and melted. I provided scan from October 7th charred body - the same way bodies were charred of Gazan people in Netzarim and AlZahraa area and many other live coverage evidence in my file to the ICC.

Colonel Nof Erez said it was Mass Hannibal.

Kibbutz witness Erez Tidhar from Eitam rescue team himself said that saw Apache helicoper and tank firing into Kibbutz, Yasmin Porat KIbbutz survivor confirmed the same crossfire + Israeli tank, Colonel Golan Vach from October 7th said that their tanks attacked to conquer back the settlement and among killed were children.

It means Israel lied and used Hannibal on October 7th - we have Kibbutz survivor and rescue team from October 7th confirming this.

I submitted so many evidence to the ICC on genocidal intent to destroy and starve Gaza.

They wanted to empty the strip to make Gazan people leave - as Donald Trump said "Netanyahu - you used my weapons very well".

We have here complicity of the US as top arms supplier and Israel. 

The focus was on children in Gaza - they wanted to prevent the entire generation of children. 

More than 50,000 children killed or injured in Gaza according to UNICEF - number higher than 4 years of world conflict according to UNRWA Chief Philipe Lazzarini.

This is genocide on Article IId of the Genocide Convention - Preventing births within the group.

What Israel has to justify damaging or destroying nearly 100% hospitals, schools and residenital units in Gaza?

Nothing.

The situation in Palestine is dire.

According to United Nations, Human Rights Watch and Amnesty International, Israeli authorities are committing crimes against humanity of apartheid and persecution. 

The report states that they have methodically privileged Jewish Israelis while repressing Palestinians, most severely in the occupied territory (Human Rights Watch Report 2021).

This systematic oppression needs immediate attention from international bodies capable of enforcing justice.

Netanyahu's term as Prime Minister was marked by numerous allegations of corruption, with charges including bribery, fraud, and breach of trust (BBC News 2019). Meanwhile, Gallant's tenure as Minister for Construction & Housing saw an increase in illegal settlement activities which are considered war crimes under international law (B'Tselem Report 2020).
