Lydia Chadwick Deserves The Right To A Fair Trial

The Issue

This petition begins with a deeply personal story. An individual, leading a simple, law-abiding life was stalked and blackmailed online for three and a half years. To make matters horrifyingly worse, they were implicated in a crime they did not commit, with indecent images of children being planted on their digital devices. This devastating episode led to a raid on their residence and subsequent arrest.

The traumatic incident that turned this person's life upside-down drowned them in an ocean of stress and fear. With no prior encounters with the law, the shock and pressure were so immense that it contributed to the development of a serious health condition - Functional Neurological Disorder (FND). The debilitating effects of this disorder vary day to day, and unfortunately, it rendered her too ill to instruct her solicitor, leaving her to fend for herself in a bewildering and intimidating legal system.

Her solicitor and barrister stepped down on the Friday just 2 days before her trial. As he couldn’t get her instructions. She was too ill to speak clearly and was given over 100 questions for her defence statement to answer by email but the stress meant letters didn’t make sense to her.Solicitor said he didn’t want to be a party to her deception as he thought she would attempt to deceive the court that she was ill when evidence was of the contrary. She was diagnosed with FND in September 2020 over 2 years before her trial and it was on her medical records as she now has a copy of them but her solicitor said it wasn’t. He let her down massively left her to represent herself and all because she was poorly. This totally discriminated against a disabled person! As if she was well she would have been able to instruct her solicitor and had the representation she deserved.

As he instructed 2 psychiatrists but both of them barely assessed her for 10 minutes. Despite the fact she was too unwell to get through an assessment, due to her speech being a bad stutter and frequent absence seizures. They deemed her fit for trial. She may have been fit but she needed communication help and representation that everyone is usually entitled to.

He instructed a Neurologist who was really bad he thought it was her speaking when it was me her mother speaking to help,as my daughter was unable to answer questions.
He wrote that her speech was articulate and readily understood. Her condition meant at times the signal didn’t get to her body parts to move. He wrote her mobility was bad as she was too fat to stand up. When it was her FND effecting her mobility. Before her condition she walked fine. So he also discriminated against my poor daughter for her weight.

When my poor daughter went to trial it was heartbreaking as it would be for any mother. The whole thing has been a total nightmare! She had a bad stutter throughout the trial. She missed a day of trial due to being unwell in hospital. It went on without her knowing what was said. Absence seizures where she became unaware what was said meant she missed bits. She wasn’t able to show her evidence including video of her mobile and laptop screen moving on its own and her webcam being on by its self when no other app was using it. And a text from the person who set her up confessing everything.
She couldn’t explain her side of the story fully due to her illness. Also she’s not legally trained, she like anyone else deserves the right to a fair trial with representation.

Had her neurologist wrote that she couldn’t get words out very well. Her solicitor said she would have had communication help at trial.
Solicitor said there was no evidence to say she was not fit for trial. Despite doctors letters stating this the judge said it had to come from psychiatrist. But both reports were no good as after less than 10 minutes assessment ended as she was to unwell. Solicitor said they are professional but FND is a new condition they may not have been experienced in that.

She was subsequently convicted and suffered 1 and half years in prison of which she was in a wheelchair the whole time. She’s out on license but has to live like a monster currently on license and on the register for life. A year after being convicted she was given a 20 thousand pound bill for solicitor to pay. Who didn’t even help better her outcome. The cost was for assessments and forensics going through her devices. Which due to her disability has been left unfit for for work. She can pay it back in instalments but she shouldn’t have to pay for a legal team who didn’t help to better her outcome in any way.

Has anyone else been blackmailed stalked set up with images?
She worked doing adult phone and webcam chat.
This person spoke in a robotic voice ,he would call on what’s app and her phone would become very hot and unable to end call or turn phone off.
After his call it would disappear from the call history. Like it never happened. He sent and received images on whats app to people she didn’t speak to. The messages appeared on her whats app like she had sent them.
He said if she told anyone he would send an indecent image of child to all her what’s app contacts saying she loved it. She did not think anyone would believe her. Due to her not having evidence of his calls. Terrified to go to the police as he said he would hurt children more if she did and it would be her fault. He told her how many contacts she had and some of their names.
He never blackmailed her for money.
He told her over and over that no one would believe her as he’s in the know and won’t be able to trace him. He even told her what her and I her mother were wearing. Park I  walked my dogs on. Private conversations she had that no one would know about. He said he could see and hear her through her phone camera whenever he wanted but she wasn’t allowed to turn it off. People in house had heard blackmailer after her arrest.
Has anyone else been hacked and afterwards no trace of it found by forensics?
it can happen as it happened to her. But due to no trace contributed to her being found guilty

We look happy on the photo as we are together again as a family. But we have been through years of hell and are still going through hell!

This is a stark example of why we need to reappraise the protections we offer to those accused of crimes, making sure every person has the right to a fair trial regardless of their health or ability. It underlines the need for robust legal systems that can guard against the manipulation of digital evidence, and the urgent need for legislation to protect against cyberstalking and online blackmail.

Everyone has the right to a fair trial. it is enshrined in the United Nations' Universal Declaration of Human Rights. Yet, this incident stands as a grim reminder that this right is not always upheld. To prevent such incidents from recurring, legislative action is urgently required.
