LPC’s unconstitutional amendment to examination syllabus of 2026

The Issue

The Legal Practice Council made amendments to their examination syllabus without giving the general public such as candidate attorneys the opportunity to comment on it. In terms of Section 95(4)(a) of the Legal Practice Act, when the LPC proposes amendments to its rules, interested persons are called upon to comment in writing. This was not complied with candidate attorneys who has passed examinations are now at risk of loosing those papers they have passed and are now only given an opportunity to write the remaining papers in two settings or they forfeit all the papers they have passed. This severely prejudices candidate attorneys as they are in no financial or any other position to start from over with the new five paper syllabus.
