Live, Laugh, Legalize: The Urgent Call for SOGIE Equality in the Philippines

The Issue

       Despite being a predominantly Catholic country, the Philippines is often regarded as one of the most LGBT-tolerant nations in Asia. According to the survey "The Global Divide on Homosexuality" by the Pew Research Center, 73% of Filipinos believe that homosexuality should be accepted by society. This reflects a relatively high level of acceptance compared to other countries in the Asia/Pacific region. Notably, acceptance is higher among younger Filipinos, with 78% of those aged 18 to 29 expressing supportive views, compared to 68% among those aged 50 and older. However, LGBT Filipinos questioned the results of this survey, claiming that LGBT Filipinos are tolerated only if they fit stereotypes. For Tan (2001), “acceptance’ is conditional as long as the bakla remain confined to certain occupational niches and fulfill certain stereotypes.” Garcia (2004) added that “when visitors to the Philippines remark that Filipinos openly tolerate and/or accept homosexuality, they invariably have in mind effeminate. 


      Beyond social perception, discrimination against LGBT individuals remains prevalent, especially in the workplace. LGBT individuals face challenges in employment both on an individual level and as members of a community that is subject to discrimination and abuse. This can be compounded by the weak social status and position of the individuals involved. In the Philippines, the governing law between employers and employees is known as the Labor Code of the Philippines, also known as Presidential Decree 442. While several articles of the Code have been amended, its main policy is the protection of workers. However, LGBT people in the Philippines encounter discriminatory practices that affect their employment status. According to a United Nations (UN) study, 30% of LGBT in the country reported being harassed, bullied, or discriminated against by others while at work because of their sexual orientation and gender identity or expression. A 2018 CNN Philippines survey revealed that 60% Filipino LGBTQ workers have been subjected to offensive slurs and jokes in the workplace, 33% Filipino LGBTQ workers experienced harassment from co-workers, and 25% Filipino LGBTQ workers experienced harassment from employers and superior officers. 


        Currently, there is no law that addresses discrimination against members of the Lesbian, Gay, Bisexual and Transgender (LGBT) community in the Philippines. Equality, enshrined as a core democratic value in the Constitution, is neither guaranteed nor operationalized for the members of the LGBT community in any existing law. It is high time for the Philippines to join the long list of countries with a national anti-discrimination law. With the hopes of giving the LGBT community full acceptance, and not just tolerance, this proposed legislation aims to finally eliminate the hate and discrimination against them. The Senate Bill no.689 known as the "Anti-Discrimination Act." AN ACT PROHIBITING DISCRIMINATION ON THE BASIS OF SEXUAL ORIENTATION AND GENDER IDENTITY OR EXPRESSION (SOGIE). 


       The SOGIE Equality Bill is a legislation that ensures equality and is meant to protect the rights of members of the LGBTQIA+, expressions of different ethnic backgrounds, differently abled, children, poor, and those of different religions. This bill recognizes non-discrimination as a national and international duty under the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights (DivinaLaw, 2020). It was first introduced in the 11th senate hearing on January 26, 2000, by Sen. Miriam Defensor-Santiago, and former Akbayan party-list Representative Etta Rosales. Since then, the bill is still in deliberations with the latest effort of Sen. Risa Hontiveros in December 2020, as the SOGIESC Equality Bill or Senate Bill No. 1934.                                                

     The LGBT community has long faced relentless hate, prejudice, and discrimination because of their sexual orientation, gender identity, and gender roles. These individuals are often subjected to verbal and physical assaults, not only from society at large but sometimes even from their own families and communities. Imagine the pain and hardship they endure simply because they are expressing their true selves and living their lives freely. Despite these challenges, it is crucial to remember that they are no different from anyone else. They are human beings deserving of love, respect, and dignity.


       We strongly urge that the SOGIE (Sexual Orientation and Gender Identity Expression) Bill be given the consideration it deserves. The foundation of our society should be built on equal treatment for all, regardless of background, gender, sexual orientation, or gender role. No person should be judged for their identity or be forced to live in fear of discrimination. We all deserve to be treated with kindness, respect, and empathy, as we share the universal right to live free from harm and prejudice.


 The SOGIE Bill is a step toward ensuring that everyone, regardless of their identity, has the right to live with dignity and respect. It recognizes the inherent worth of each individual, regardless of who they love or how they choose to express themselves. By focusing on equality, the bill emphasizes that we are all equal, regardless of our differences, and that these differences should be celebrated rather than condemned. A society that acknowledges and cherishes diversity is one that will thrive.

By increasing awareness and understanding, it becomes possible to shift public perception and build a stronger movement in support of the bill’s passage.
