Liberate beloved father from an unjust sentencing

The Issue

Hello World, 

You don't know me and that's okay, but I’m sure you will still understand my dilemma. All that's needed is a listening ear, a heart to empathize with, and your support. My name is William Demarcus Brown, currently a resident of the Ferguson unit in Midway, Texas of T.D.C.J., serving a 40-year sentence over a fallacy.

I've been incarcerated going on 18 years now. I'm 36 years old and have been in prison since I was 18 years old. My case is a very peculiar one, I was charged with aggravated kidnapping of my own son. Though he isn’t biologically mine, upon meeting my children’s mother (CM), I promised to be his father & raised him since he was 8 months old. This charge is aggravated only because of the time this incident occurred, which was around 10:30 pm. No weapons were involved, no one was hurt, nor were there any attempts to hurt anyone.

In brief, my CM & I had 2 boys at the time. A 22 month old & a 1 1/2 month old. I'd came straight home from work that night around 10:00 pm. Shortly after my CM & I got into an argument, which brought about her leaving out with our youngest son. Unbeknown to me because I was in the restroom. Upon me coming out, I see our oldest moving around the house. I grabbed him & went looking for my CM. We went around asking neighbors to see if they had seen her anywhere, all to no avail. While in lieu of looking for her, the police showed up & because I had a trespassing warrant, I thought it was best to leave the area & go to my uncle's house 2 blocks away. On the way there I was arrested & charged with AGGRAVATED kidnapping...No weapons, no threats, no one hurt, literally nothing. This is my son that I truly and dearly love. I was the one who changes his diapers, feeds him, cloths him, baths him, provides for him, etc. So there isn't any foul play. We are in belief that the sentence given was very excessive in relation to the actual incident that occurred.

This has had such an enormous effect on our family, from my children being angry with me for not being there, them not understanding why I’m not there, experiencing depression, & acting out. It hasn’t been easy, but God has been there walking with each one of us every step of the way, molding & shaping us.

So just recently I found out that my lawyer that represented me at the time of my conviction withheld some very valuable information from me. In the form of an offer of 25 years from the District Attorney. Now 25 years is still a lot of time considering what happened. However, it’s a significant difference from the 40 years. Being that I never turned that offer down and/or never received that offer, by law that offer still stands today. 

So, we're praying & asking for your support with this petition. With your help we'll present this petition before the court and show him that not only does he have your support and backing in signing off on this commutation but that you also believe that this is in the best interest of all parties involved.

  • Teachers Aid (TA) in welding (2021 – Present)
  • Currently working towards Religious Studies degree from Nations University
