LET THEIR DEMANDS BE ACCEPTED, LET EDA LIVE!

 

Eda Deniz Haydaroğlu, a Turkish-German citizen, started a hunger strike on March 18, 2023, in front of the Ministry of Justice in Berlin, demanding the release pending trial and fair trial of three Turkish individuals, Özgül Emre, İhsan Cibelik, and Serkan Küpeli, who have been held in custody and undergoing trial in Germany for 1.5 years. After some time, Ilgın Güler, Sevil Sevimli, and İleni Açıkgöz also joined this hunger strike. In these days, Eda Deniz Haydaroğlu has completed 250 days of her hunger strike. The other three individuals who started their hunger strikes on different dates have been continuing their hunger strikes for months.

The three Turkish defendants, for whom Eda Deniz Haydaroğlu and her friends demand a trial without custody, are being tried on charges of "being a member of a foreign organization" under Article 129/b of the German Criminal Code. Eda Deniz Haydaroğlu and her friends demand an end to the violations of the right to a fair trial, including the prosecution being conducted with the permission/instruction of the Ministry of Justice and the limitation of the right to defense. They also demand the release of İhsan Cibelik, who was suspected of cancer before being arrested but whose diagnosis and treatment procedures were delayed for 16 months during the period of detention, and was diagnosed with prostate cancer within that time, within the context of his right to health and treatment.

In modern criminal law, it is a rule that the trial should be conducted without custody, while custody should be a "measure that should be resorted to exceptionally", and it is clear that the basic demand of Eda Deniz Haydaroğlu and her friends for "trial without custody" is a lawful, reasonable, legitimate, and acceptable demand in the face of the fact that even individuals who are caught with heavy weapons in similar trials can be tried without custody.

On the other hand, the right to health and life should be preferred over arrest or the execution of penalties, and is even necessary. Therefore, the demand for "the release and trial without custody of İhsan Cibelik, who has been diagnosed with cancer" is also a lawful, reasonable, legitimate, and acceptable demand.

Eda Deniz Haydaroğlu has completed 250 days of her hunger strike with these demands, which are lawful, legitimate, and feasible. Therefore, she is experiencing various health problems due to prolonged hunger, and these problems are increasing day by day, and her health has already begun to deteriorate in a way that cannot be reversed. In addition, the experiences we have gained from previous hunger strikes show that there is a serious risk to the life of Eda Deniz Haydaroğlu, who has been on a hunger strike for more than 250 days.

Therefore, as human rights advocates and organizations whose signatures are included in this statement, we defend the right to life of Eda Deniz Haydaroğlu and her friends, and we call on the relevant institutions, which are the recipients of their demands - as explained above, which are legal, legitimate, and feasible - to immediately accept their demands and eliminate this threat to their lives.
