Support the Reopening of the Kindred Roots Farmstand

We believe South Point should have a reasonable pathway for small, home-based businesses to operate responsibly within our community.

Small businesses contribute to the character, economic activity, and sense of community that make South Point a place we are proud to call home.

Kindred Roots is a small, locally owned cottage food business—not a large commercial bakery, restaurant, or retail establishment. Its operation is intentionally limited in scale, and its owner has demonstrated a willingness to work with the Village and comply with reasonable requirements.

We believe there is an opportunity for South Point to protect its neighborhoods while also supporting responsible small-business activity. These goals do not have to be in conflict.

We therefore respectfully ask the Village Council to hear the voices of the residents, customers, and community members represented by this petition and to work toward a lawful, reasonable, and clearly defined path for reopening the Kindred Roots Farmstand.

We are asking for an opportunity for a small local business to operate responsibly, contribute to our community, and continue growing right here in South Point.

Kindred Roots Baked Goods & Provisions is a locally owned cottage food business operated by South Point resident Kaitlin Gallimore. The business was established to provide locally made baked goods and other small-scale goods to members of the community.

The Kindred Roots Farmstand was established as a small, home-based point of sale for products produced by the business. Following concerns regarding the Village’s zoning regulations and their application to the farmstand, the operation was required to close.

We recognize and respect the Village’s responsibility to enforce its ordinances and to protect the health, safety, welfare, and interests of its residents. We also believe that local government and small businesses can work together to find reasonable solutions when existing regulations do not clearly address newer forms of small-scale, home-based commerce.

WE RESPECTFULLY REQUEST THAT THE VILLAGE COUNCIL:
1. Reconsider the closure of the Kindred Roots Farmstand.

We ask the Village Council to reconsider whether the current application of its zoning regulations to the Kindred Roots Farmstand is appropriate for the nature, size, and operation of this cottage food business.

2. Review the applicable zoning provisions and their application to cottage food businesses.

We respectfully request that the Village review the applicable provisions of its zoning ordinance, including the provisions relied upon in closing the Kindred Roots Farmstand, and consider whether those provisions adequately distinguish between large-scale commercial operations and small, home-based cottage food businesses.

3. Explore a lawful pathway for the Kindred Roots Farmstand to reopen.

If the existing ordinance does not permit the farmstand as currently structured, we ask the Village Council to consider reasonable legislative or administrative options that could allow a small cottage food farmstand to operate in an appropriate residential setting while addressing legitimate concerns such as traffic, parking, hours of operation, signage, noise, sanitation, and impact on neighboring properties.

4. Consider clear and consistent rules for similar small businesses.

We believe South Point would benefit from clear, predictable standards governing small cottage food businesses and similar home-based enterprises.

Rather than creating an exception solely for one business, we encourage the Village to establish a fair framework that could apply consistently to similarly situated businesses in the future.

5. Continue working with Kindred Roots toward a mutually acceptable solution.

We respectfully ask that the Village Council, its administration, and the owner of Kindred Roots continue communicating in good faith to identify a solution that complies with applicable law while allowing this locally owned business to serve the community.

We respectfully ask the Village Council of South Point to reconsider the closure of the Kindred Roots Farmstand and work with Kindred Roots to establish a lawful pathway for the farmstand to reopen and operate under reasonable, clearly defined standards.
