Let’s legalize marijuana in Indiana!
The Issue
Marijuana policy reform is sweeping the Midwest! Indiana’s neighbors to the north (Michigan), west (Illinois), east (Ohio), and south (Kentucky) have all legalized marijuana for recreational or medical use, with Ohio and Kentucky advancing their programs in recent years to include broader access.
Unfortunately, Indiana continues to lag behind its neighbors and the rest of the country on marijuana policy. It is one of only 19 states that still imposes jail time for simple possession of cannabis and one of only 10 that lacks a comprehensive medical cannabis law beyond limited CBD oil.
Under current law, possession of even a small amount (up to 30 grams) is punishable by up to 180 days in jail and a fine of up to $1,000, with harsher penalties for larger amounts. These laws are not being equally enforced; Black Hoosiers are more than 3.5 times more likely to be arrested for marijuana possession than white Hoosiers.
Multiple bills to decriminalize or legalize marijuana, including HB 1630 and HB 1654 for adult-use regulation and HB 1178 for medical expansion, were introduced but failed to advance during the 2025 legislative session. As more states move forward, it’s only a matter of time before Indiana improves its laws. Make sure your lawmakers know this issue matters to voters: Ask your lawmakers to decriminalize marijuana possession and expand medical access in 2026.
Please also consider asking your legislators to support legalizing and regulating marijuana like alcohol. This sensible approach would reduce the number of marijuana-related arrests, redirect law enforcement resources to real crime, and create a new source of revenue for the state.
Governor Mike Braun signed a law banning marijuana advertising on May 7, 2025, and has expressed cautious openness to medical marijuana while emphasizing protections against psychoactive THC products.
