Legalizing Same-sex marriage in India
The Issue
On 6th September 2018, the Supreme Court of India decriminalized homosexuality. It was hence legalized to be queer in India but the queer adults never fully got their rights that is talking about tying the knot together.
On November 14th, 2022, two same-sex couples filed Writ petitions in the Supreme Court seeking legal recognition of same-sex marriages in India. The petitions were centred around the constitutionality of the Special Marriage Act, 1954 (the Act).
Thus, Supriyo Chakraborty and Abhay Dang, was the first amazing queer couple to fight for their rights and today we stand up to follow their footsteps as unfortunately but un-shockingly, The Centre in a filing to the Supreme Court on Sunday stuck to its earlier stand that same-sex marriage is not compatible with the concept of an "Indian family unit", which it said consists of "a husband, a wife, and children which necessarily presuppose a biological man as a 'husband', a biological woman as a 'wife' and the children born out of the union between the two - who are reared by the biological man as father and the biological woman as mother".
Therefore, we gather together to raise this petition to bring it to the notice of the supreme court to not listen to the Centre and give the queer adults the full rights to live together as a married couple just like any of heterosexual couple. Because Queer is Normal.
