Legalize Toplessness for Women in Public Spaces
The Issue
As someone who has been fortunate to experience the freedom and respect in European societies, where women can freely remove their shirts without fear of legal repercussions, I am deeply troubled by the inequality that persists in our own society. The prohibition on women engaging in the same simple act as men - going topless - is not only unjust but also runs counter to the principles of our Constitution.
It's worth noting that just about a century ago, men faced legal consequences for going topless in public places in America. Today, we rightly perceive such a law as both absurd and discriminatory. So, the question naturally arises: why do we persist in enforcing similar restrictions against women? The 14th Amendment guarantees all citizens equal protection under the law, and it's high time we extend this protection to the right of women to bare their chests.
In a pertinent legal context, a recent case in Colorado sheds light on the issue. The Court of Appeals upheld a district court decision that the city’s topless law violated the Fourteenth Amendment. In the majority opinion, Judge Gregory Phillips wrote:
“We’re left, as the district court was, to suspect that the City’s professed interest in protecting children derives not from any morphological differences between men’s and women’s breasts but from negative stereotypes depicting women’s breasts, but not men’s breasts, as sex objects…”
This observation highlights that societal norms and stereotypes, rather than any legitimate legal reasoning, underpin such restrictions.
Interestingly, in Europe, where such laws do not exist, there are fewer reported cases of sexual assault and lower overall violence compared to America, as indicated by a UNODC report. This strongly suggests that allowing women the same freedoms as men does not lead to societal harm; on the contrary, it fosters an environment of mutual respect.
The time has undeniably come for us to challenge these outdated norms and champion the cause of equality.
