Legalize Audio and Video Recordings of Harassment, Abuse, and Threats in All 50 States

The Issue

We, the undersigned, call on the United States Congress to enact the Federal Victim Protection Recording Law, a national policy that: Legalizes audio and video recordings made for self-protection and as evidence of harassment, abuse, threats, or assault regardless of state consent laws. Protects victims from criminal prosecution when their intent is to document misconduct, danger, or abuse. Makes these recordings admissible as evidence in workplace investigations, school hearings, or criminal courts. Overrides conflicting state consent laws in cases where the recording is made to report a crime, harassment, or workplace violation. Why This Law Matters: Victims deserve protection, not punishment. No one should face jail time for trying to defend themselves or prove their innocence. Abusers exploit outdated consent laws. These laws, meant to protect privacy, are now used as shields by perpetrators who know their victims cannot legally record them. Evidence saves lives. A single recording can expose a predator, stop workplace retaliation, or prevent a future assault. Equal protection for all Americans. Every citizen deserves the same right to safety and justice, no matter which state they live in. This proposal is rooted in the 14th Amendment’s Equal Protection Clause and the federal government’s duty to ensure public safety and civil rights. Just as federal law prohibits discrimination in workplaces and schools, it must also ensure victims can document and report harassment without fear of prosecution.
