To the House of Commons in Parliament Assembled:
We, the undersigned citizens and residents of Canada, respectfully call upon the Government of Canada to modernize Canada's self-defence laws by permitting the lawful possession and use of pepper spray for personal protection, subject to reasonable regulations, training requirements, and criminal penalties for misuse.
Whereas:
Canadians have a fundamental right to personal safety and security.
Violent crimes, assaults, robberies, stalking incidents, and attacks against vulnerable persons continue to occur in communities across Canada.
Many individuals, including women, seniors, shift workers, security personnel, transit users, students, and persons living in remote areas, often find themselves in situations where immediate police assistance is unavailable.
Pepper spray is a non-lethal defensive tool designed to temporarily incapacitate an attacker, creating an opportunity for a victim to escape and seek help.
Compared to many other defensive options, pepper spray significantly reduces the likelihood of serious bodily injury or death to both victims and offenders.
Numerous democratic nations permit regulated civilian possession of pepper spray, including certain jurisdictions within the United States and Europe, with established safeguards and training requirements.
Current Canadian law generally prohibits the possession of pepper spray intended for use against humans, leaving many law-abiding citizens without an effective means of self-defence.
Providing responsible adults with access to a regulated, non-lethal defensive tool may enhance public safety while reducing reliance on more dangerous forms of force.
We Therefore Request That the Government of Canada:
Amend the Criminal Code and related federal legislation to permit the lawful possession of pepper spray for personal protection by adults who meet prescribed requirements.
Establish a licensing or certification system requiring basic safety training on lawful use, storage, transportation, and reporting requirements.
Create clear standards governing the strength, size, and approved types of pepper spray available to the public.
Impose strict criminal penalties for misuse, assaultive use, reckless discharge, or use during the commission of a criminal offence.
Permit retailers to sell approved products only to eligible adults who have met all legal requirements.
Require public education regarding the lawful use of force and the limitations of self-defence under Canadian law.
