The Hawaii Legislature has voted to AMEND THE FINAL VERSION OF SB2524 TO APPLY ONLY TO COUNTIES WITH MORE THAN 750,000 RESIDENTS (i.e. Oahu only). As such, the creation and registration of new CPRs on the neighbor islands should still be possible for at least another year! Several Maui representatives rose to the occasion to make this possible and DESERVE OUR SUPPORT, including County Council Planning Chair (and 2018 State House Candidate) DON COUCH, Senate Majority Leader J. KALANI ENGLISH, Senator ROZ BAKER, Representative LYNN DECOITE, Representative KYLE YAMASHITA, and Senator GILBERT KEITH-AGARAN. In addition, special thanks to Josh Stone (Big Wave Realty) and Lawrence Carnicelli (Realtors Association of Maui) for their tireless efforts and to the many others who contributed their time, testimony, and expertise. Thanks also to the 650+ individuals who signed the PETITION! Please continue to share and encourage others to sign to (1) urge Governor Ige to veto the bill and (2) send a clear message to State lawmakers to STOP confusing the CPR form of ownership with County regulated subdivisions and County-specific land-use laws. Interested parties should continue to follow the Hawaii Legislature regarding any future bills that would make the already overregulated CPR process even more difficult. A NOTE TO OUR OAHU FRIENDS: We did everything in our power to kill this illogical bill but the City and County of Honolulu Planning Department and Oahu Representatives ultimately got their way. It is worth noting that the county “verified statement” requirement of “compliance with subdivision or equivalent requirements” was replaced by “may include comments on the availability of supportive infrastructure, the potential impact on environmental resources, and other requirements of county ordinances and rules.” We are not sure how this would affect issuance of future verified statements on Oahu, but at least the inaccurate term “subdivision” was removed from this section of the CPR law. We recommend that interested parties on Oahu contact Governor Ige to demand he Veto this bill, as we are certain that he understands that county land-use codes, development standards, and enforcement are strictly county issues (not related to the CPR form of ownership). The Governor is also a huge proponent of creating new affordable housing, which is one of the main benefits of the CPR process.
