1) Please use link to tell Starbucks to write to Brookfield properties saying their exclusivity agreement is not breached by Kismet Turkish Cafe and Bakery selling Turkish coffee drinks.

2) Then please write emails and call Alderwood Mall's corporate offices and urge them to tell Starbucks "we will risk a lawsuit by Starbucks as there is a clear difference between Turkish coffee lattes and espresso lattes. Or if Starbucks proves it is broken and therefore it gets to pay 50% less per their lease, so be it. Let other businesses come into your 250 Mall locations and sell coffee because we need options besides Starbucks.

We, Kismet Turkish Cafe & Bakery, are a small, local, family business at the Alderwood Mall in Lynnwood, Washington (Seattle metro).

Across from us there is a Starbucks. Their corporate headquarters has decided to make pressure on Mall Management about our cafe selling Turkish coffee based drinks. This has resulted in the  corporate headquarters of the mall to tell us that we have to move from this busy center court location.

How can they make this pressure? They have an exclusivity agreement in their contract with the mall that prevents competition by stating no other businesses can sell espresso or coffee beans In most parts of the mall.

So why after we have been in business for 3 years does Starbucks decide to put this pressure, especially considering that we do not break the agreement as we serve Turkish coffee drinks not espresso drinks.  The answer is that they have convinced the attorneys of the headquarters of this mall, Brookfield Properties Retail, that Starbucks will win a court case determining that espresso coffee drinks are the same as Turkish coffee drinks. If this is so that means Kismet is creating competition that violates the exclusivity clause in the agreement.

What do you all think? We personally think that there is a reason that there are distinct names for different kinds of coffee. They exist because each kind of coffee is different! So I don’t think Starbucks would win. Even so, Brookfield doesn’t want to take a risk especially considering that we are just a small company and Starbucks is a worldwide Corporation.

As a result the Alderwood Mall and their corporate offices will not continue to try to move us from our current location in the center court. Kismet spent $250,000 to build their business as they had to saw cut down to install the foundation of the plumbing and electricity. Then they had to cement it back to the surface, tile it and then build a gem of a kiosk bringing wonderful diversity to the mall. If Starbucks doesn't inform Brookfield, then we can't hope to prevent them from following through with their 3rd notice for us to move out of our space #5538 by May 31, 2022!!!

THEY JUST CALLED US TO SAY THAT THEY WILL TERMINATE OUR AGREEMENT!!! Meaning the mall is going to revoke our license and we have to leave and everything that is in the mall by June 1st is property of theirs.

3) If anybody knows an attorney that could help prove the opinion of #2, please let us know!

4) A major newspaper wants to print an article about us if they learn about two other companies that have been affected similarly by Starbucks. If you know anyone please put me in contact with them so I can connect them with this major newspaper! kismetcafebakery@gmail.com
