Kerry Baxter Seniors right to a Speedy Trial was ignored and so was his right to a Fair Trial. There were African Americans on the Jury panel who were dismissed by the DA and the Judge allowed it! Even with an All White Jury it took 10 days for them to decide that he was guilty. Judge Jeffrey Horner was the same Judge overseeing the Riders Trial which resulted in a Hung Jury. He would not allow the Jurors to come out without a verdict and told them that the Word of a Police Officer held more weight than the defendants. They then when in for another day and found Kerry Baxter Senior Guilty. The Asst. DA Colleen McMahon overseeing the case not only targeted Kerry Senior but spoke against his family. She is the one who along with the Oakland Police gave Blanket Immunity to Jahmani Jones to testify against Kerry Senior. They knew that he had been the aggressor but Kerry Senior who was working paying taxes and raising a family was a more important target. There are a number of issues with the Police Department who wanted Kerry Senior to be an informant but he refused so they would throw him in Jail on a 72 hour hold!
Kerry Senior was one of the young black men who was pepper sprayed by Police at the Festival by the Lake in Oakland. He testified against the Police and there was a large settlement paid out. He and any other black person that speaks against OPD is targeted. Anyone who lives in the Community know that they conspire and retaliate against black and brown folks in the community!
Since Kerry has been in prison his oldest son and name sake was lured to a Park in East Oakland and murdered. The Oakland Police officer overseeing his Case was the same one who lied in Court to Convict Kerry Baxter Senior. The same one who Kerry Junior said was harassing him when he would go to Oakland. The same ones who were tapping the phones of Kerry Seniors family even after he was in Prison! There are folks in Oakland that know what happened and are afraid or indebted to the status quo. The former DA who refused to investigate the murders of black and brown citizens was a Democrat. That means neither party cares about the people and especially African American People.
Kerry Baxter Senior is not only in Prison! They put a Gang enhancement on his jacket so that he is always at least 100 miles! He was 31 years old when he was arrested lived in Berkely worked and was raising a family. The Gang they mentioned did not even exist it was made up by OPD so that they could get money and have more rights to arrest young black and brown men! He is being moved around from prison to prison every 2 months so impeding him from doing legal work or completing training or classes. They also impede his ability to make phone calls and hang up in the middle of his calls. It is not only the City and County this is a State issue and there is little or no rehabilitation. What the Right does is try to outwait the Governor. So when Newsome supports Rehabilitating the Prisons they target the Prisoners by putting them on lock down and throwing them in ad seg!
