Petition Title: Justice Without Time Limits Act - End the Statute of Limitations on Rape & Domestic Violence Injuries

 

To: The United States Congress

 

We, the undersigned, call on Congress to pass the Justice Without Time Limits Act, which would eliminate the statute of limitations for rape and domestic violence cases resulting in injury. Survivors deserve the right to seek justice, no matter how much time has passed.

 


Why This Matters:

  •  Many survivors delay reporting due to trauma, fear, or systemic failures in law enforcement.
  •  Thousands of rape kits remain untested across the country, allowing perpetrators to walk free.
  •  Advances in forensic DNA technology allow cases to be solved even decades later.
  • Survivors own their DNA and deserve access to rape kit results upon request.
  • No perpetrator should evade justice simply because of an arbitrary legal time limit.

 


We Demand:

  • The elimination of the statute of limitations for rape and domestic violence injuries at the federal and state level in the United States.
  • Mandatory rape kit testing and a national rape kit tracking system.
  • The right for survivors to access their DNA test results without obstruction.
  •  Special Victims Units (SVUs) in every law enforcement agency, ensuring trained officers handle these cases properly.

 


Justice should never expire. We urge Congress to take immediate action by sponsoring and passing the Justice Without Time Limits Act. Survivors deserve better.

Federal Bill to Eliminate the Statute of Limitations for Rape and Domestic Violence Resulting in Injury

Bill Title:

Justice Without Time Limits Act

Section 1: Short Title

This Act may be cited as the “Justice Without Time Limits Act.”

Section 2: Findings & Purpose

(a) Findings:

Congress finds the following:

 1. Survivors of rape and domestic violence with injuries often experience delayed reporting due to trauma, fear of retaliation, or coercion.

 2. Advances in DNA technology and forensic science allow for the identification and prosecution of offenders long after the crime occurs.

 3. Statutes of limitations deny justice to survivors who come forward later and allow offenders to escape accountability.

 4. Several states have removed or extended statutes of limitations for sexual offenses and domestic violence, but a federal standard is necessary to ensure equal justice nationwide.

(b) Purpose:

The purpose of this Act is to:

 1. Eliminate the federal statute of limitations for rape and domestic violence cases resulting in injury.

 2. Provide survivors with unlimited time to seek justice.

 3. Encourage state legislatures to adopt similar policies.

Section 3: Amendment to Federal Law

(a) Repeal of Statute of Limitations for Rape and Domestic Violence Resulting in Injury

 1. Title 18, United States Code, is amended to remove time limits on the prosecution of:

 • Rape, sexual assault, or any non-consensual sexual act.

 • Domestic violence offenses that result in serious bodily harm, permanent disability, or psychological trauma as diagnosed by medical professionals.

(b) State Incentives for Compliance

 1. Federal funding for state law enforcement agencies shall be contingent upon states adopting similar provisions in their criminal codes.

Section 4: Application & Retroactivity

(a) This Act shall apply to all future offenses and allow the reopening of previous cases that were closed solely due to statute of limitations restrictions.

(b) No time limit shall bar survivors from seeking criminal prosecution, provided sufficient evidence exists to prove the crime.

Section 5: Congressional Oversight

(a) A national commission shall be established to review the impact of this Act and ensure fair implementation.

(b) The Department of Justice shall issue guidelines to help law enforcement handle cases under this new standard.
