The Issue
For decades, Mr. Mbadiwe Ossai, a law-abiding citizen and president of Mbadiwe Ossai Multi-Purpose Cooperative Society Ltd., has faced relentless harassment, unlawful detention, and gross violations of his fundamental human rights. Despite holding multiple court judgments confirming his ownership of 11 beaches along the River Niger in Asaba, Delta State, Mr. Ossai and his workers have been subjected to unimaginable injustice.
We call on all Nigerians, human rights organizations, and the international community to demand immediate action to end this persecution.
The Problem
Unlawful Arrest and Detention:
On October 29, 2024, Delta State Police Command, under CP Abaniwanda Surajudeen Olufemi and CSP Gladys Ekpakuemu Imegu, unlawfully invaded Mr. Ossai's residence without a warrant, arresting him and 16 of his workers. They have been detained for over a month without arraignment, violating their constitutional rights.
Violation of Court Judgments:
Mr. Ossai's ownership of the 11 beaches has been affirmed by multiple court judgments (Suit Nos. FHC/B/CS/157/2000, FHC/B/CS/287/2003, FHC/B/CS/98/2004). Yet, the Delta State Police Command continues to act in contempt of these orders, enabling criminal trespassers to occupy the property illegally.
Corruption and Abuse of Power:
Police officers, including CSP Imegu, have allegedly colluded with criminal elements, accepting bribes to suppress justice. Instead of protecting the rightful judgment creditor, they have perpetuated oppression and insecurity in Delta State.
Endless Harassment:
Over the years, Mr. Ossai has been unlawfully arrested more than 50 times. His workers have been falsely accused of terrorism, conspiracy, and other fabricated charges. These acts are meant to punish him for standing up for his rights.
Loss of Lives and Property:
Four workers were killed in 2011 during an attack on the judgment area. Mr. Ossai and his workers have suffered repeated destruction of property, loss of livelihood, and physical and emotional trauma.
Our Demands
We urge the National Human Rights Commission, Inspector General of Police, and the Federal Government of Nigeria to:
Order the Immediate Release of Mr. Mbadiwe Ossai and His Workers:
They must be released from unlawful detention at the Delta State CID, Asaba, and their charges reviewed transparently.
Investigate and Prosecute Corrupt Officers:
Officers involved in this travesty, including CP Abaniwanda Surajudeen Olufemi and CSP Gladys Ekpakuemu Imegu, must be thoroughly investigated and held accountable for their actions.
Enforce Compliance with Court Judgments:
The Inspector General of Police must ensure the enforcement of the Federal High Court's judgments affirming Mr. Ossai’s ownership of the beaches.
Protect the Rights and Safety of Mr. Ossai and His Workers:
The Federal Government must guarantee their safety and protect them from further harassment, intimidation, or harm.
End Police Brutality and Corruption in Delta State:
We demand an overhaul of the Delta State Police Command to eliminate corruption and ensure accountability.
