At the bail revocation hearing today many Justice for Moose supporters attended. The details of the bail violation became clear. A Green River High Student named Tracie reported Johnson to the Green River police after Johnson attended several open gym nights where children between the ages of 11 and 18 were playing soccer. The defense (Gary Guelker and David Irvine) argued that the judge's order that Johnson have no contact with animals or children was vague. Johnson interpreted it to mean no contact with small children, not older children. The defense argued that there were no incidents so the judge should not consider it a violation. They argued that if she did decide it was a violation that the $150,000 cash only bail was uncalled for. The prosecuting attorney, Andrew Deesing argued that Johnson had been reminded of the no contact order at the Feb. 18 preliminary hearing and because he was so far from any court supervision he flouted the court's authority and did whatever he wanted. He also pointed out that obviously the good people of Green River, Wyoming, interpreted the judge's order of no contact with children to apply to people under the age of 18. In addition he pointed out the fact they reported Johnson to the police showed that they feel he is a definite threat to public safety.
The Honorable Judge Katherine Bernards-Goodman held that Johnson did violate the no contact order with children and clarified that she intended it to apply to children under the age of 18. She kept the $150,000 bond amount the same but allowed it to be bondable (meaning that his family could pay $15,000 to a bail bondsmen and get Johnson out of jail). She is still allowing him to go back to Green River if he gets out of jail.
We got reports from people in Green River, Wyoming, that Johnson's family had gathered the money to bail him out of jail as of Monday night (3/14/16) so it is a matter of time until he gets out.
The defense argued that Johnson has no money since because of the publicity of this case that he can't get a job and he also dropped out of college. The judge pointed out that if he has no money how is he affording private counsel. David Irvine interjected that Mikah Johnson's grandfather was retired army and was one of the men under his command when he was a Brigadier General. He said he knows the family and that is why he is helping to represent him.
David Irvine is known nationally as an anti-torture advocate and has appeared on many national television programs including The Daily Show with Jon Stewart pushing his anti-torture platform. It is disappointing that someone who has done so much good is siding with someone who tortured an innocent puppy. Apparently it is not OK to torture terrorists but it is OK to torture a helpless, innocent, puppy. The next court date is April 6 at 2 PM, Matheson Court House, 450 State Street, Salt Lake City, UT, Room W-43 (Fourth Floor). That hearing will be to discuss a motion by the defense to "sever" the charges. We think the defense is trying to get the domestic violence charge to be handled separately. This would be to the defense's advantage since even if someone on the jury didn't care about torturing an animal, they would probably care about a woman abuser.
