Justice for Marimar Martinez and Accountability for Border Patrol Violence

The Issue

Marimar Martinez is alive today by sheer chance.

On October 4, in Chicago, a 30-year-old lifelong South Sider was shot five times by a U.S. Border Patrol agent during a traffic encounter. She was unarmed in any meaningful sense, trying to escape what she feared would be violent arrest, and she nearly bled to death before reaching help. She survived — but only after suffering permanent nerve damage to her hand.

That alone should have demanded an immediate, transparent investigation.

Instead, the federal government publicly labeled Marimar Martinez a “domestic terrorist,” splashed her photo online, and pursued criminal charges that were later abruptly dropped. Those charges collapsed after serious questions emerged about the agents’ actions, missing body-camera footage, and evidence suggesting at least one bullet struck her from behind. To this day, the government has not corrected the public record or rescinded its accusation.

This is not just about one woman. In recent months, Renee Macklin Good and Alex Pretti — both U.S. citizens — were also shot and killed by immigration agents, then posthumously branded “domestic terrorists.” They do not get to tell their stories. Marimar does.

The pattern of deadly force followed by public smears shows a systemic failure of accountability.

We are calling on Department of Homeland Security Secretary Kristi Noem, Customs and Border Protection leadership, the Department of Justice Civil Rights Division, and the DHS Office of Inspector General to act.

Marimar Martinez deserves justice. That means a full, independent investigation into the shooting, public correction of false claims made against her, and real consequences when federal agents abuse their power. Federal law enforcement must be held to the same standards as everyone else.

No one should be shot five times, jailed, and publicly branded a terrorist — only to have the government walk away without explanation.
