The Issue
Hello all, thank you for taking the time to look into our story. In 2007 my father, Kevin Blevins was taken into custody on charges he had received of possession with intent to distribute 50 grams of methamphetamine and received a 380 month sentence (That is more than most people get for murder.) I would also like to add my father is classified as a non violent drug offender. The judge that sentenced my father is named John H. McBryde. “McBryde is commonly considered to be one of the least lenient federal judges in the State of Texas. Judge McBryde also has a reputation for upward departure or sentences on the high end of the guideline range.” Quoted from Dallasjustice.com. If you look into McBryde he has several complains on over sentencing. My father has had several time deductions after the first step act was passed and does not have a violent history since being incarcerated but in the federal prison you are required to serve day per day. We have made every attempt we can to get my father home including applying for the cares act which would allow him to serve out the rest of his time on a ankle monitor at home but we have been turned down due to a “violent history” which was one misdemeanor he received when he was working as a body guard for a bar in his early 20s where he was charged for a petty assault so the man could sue the bar my father worked for. My father has served well over 70% of his sentence, has no violent history besides that one blemish and is over the age of 50 which should qualify him for the cares act however we continue to be turned down. If you would take the time to sign our petition we may be able to persuade the court to allow him to serve the rest of his time on home confinement. He has served over 15 years. Missed out on his childrens lives, the birth of all 5 of his grandchildren and 15 years of time with his wife. We all miss him and just want him home. He has done more than enough time.
