I would like to thank everyone who has been a constant support and my motivating drive to continue seeking to get justice for Katherine and Rehlin. I recently found out that Katherine and Rehlin’s story was put into a brief of the Florida Supreme Court. Aramis Ayala is the State Attorney duly elected in Orlando by the people. She had 23 cases taken away from her by Governor Rick Scott because of her decision ( after through investigation and research) not to seek the death penalty on Markeith Loyd who killed a police officer and his pregnant girlfriend. To make matters worse for Ayala and the people of Orlando who elected Ayala to be the first black woman to be State Attorney, Governor Rick Scott gave her 23 cases in her jurisdiction to State Attorney Brad King. Brad King is the same State Attorney who refused to prosecute my daughter and grandson’s killer. Ayala filed suit against Governor Rick Scott and State Attorney Brad King. Her being the smart woman she is, added cases to her law suit that should have been prosecuted but were not or were prosecuted in correctly to her brief. “The Florida Constitution limits the Governor’s intervention in criminal investigation and prosecution. The state attorney is an elected official charged with certain discretionary duties, including the duty to determine whether or not it is appropriate to prosecute any particular crime committed within his or her jurisdiction. This decision is based on the quality and quantity of the evidence of guilt shown, and in the best interest of justice.” “The state attorneys operate independently of the Governor’s Office, and as elected officials, they answer only to the voters of their individual jurisdictions.” These statements are verbatim to what Governor Rick Scott’s office had replied to my request for help in getting my daughter and grandson’s case prosecuted. So my question was how could he take Ayala’s cases from her? This could only mean he lied to his constituents. This is the same statements his office made to other’s who have asked for help. After seeing what Governor Rick Scott did to Ayala with taking her cases away and giving them to Brad King it infuriated me. Ayala never said she wouldn’t prosecute, she only said she would not seek the death penalty as it is costly to prosecute, you need 12 jurors to agree to the death penalty and the inmate stays on death row for years before execution. The Florida death penalty also at the time was under review. http://www.floridanewsflash.com/news/news-state-us/south-florida-judge-rules-death-penalty-fix-unconstitutional/. There is no evidence that the death penalty is better than life in prison without the possibility of parole. Ayala did not use Brad King’s famous excuse “Not enough evidence to prosecute.” I might add that Aramis Ayala is a democrat and Governor Rick Scott as well as Brad King are both Republicans. If you think politics does not play a role in this state you are very wrong cause it does big time. I have learned this from first hand experience. I would also like to bring to light cases Brad King did not prosecute that should have. He is responsible for Hernando, Lake, Sumter, Marion and Citrus Counties. How does he have time to prosecute in other counties? Why does Rick Scott continually ask Brad King to be special prosecutor in other counties when he can not handle cases in his own counties? What is the connection between Brad King and Rick Scott other than professional? How come Brad King uses the excuse Insufficient Evidence to prosecute cases involving police enforcement and politicians? Prime example: Hernando County Commissioner Nick Nicholson who has been in trouble on prostitution and brothel charges for several years once again was arrested on brothel and prostitution charges. The first time was in 2015, that lead to a two year investigation by the FDLE into Nicholson for drugs and prostitution was dismissed because State Attorney Brad King didn’t feel he could get a conviction. The outcry of the public is for Governor Rick Scott to remove him from office but of course Governor Rick Scott only suspended him until the outcome of the charges. Maybe because Nicholson has endorsed Scott. Now with the overwhelming evidence and statements in this latest case we shall see if once again if Brad King feels it is insufficient evidence to prosecute Nicholson. This is just one example. There is many other cases you can look into. Just a few to mention Justice for Michelle O'Connell Justice for Patrick and Evelyn DePalma
