The Issue
Justin Montgomery's journey through the criminal justice system is a heartbreaking tale of a flawed process that has kept an innocent man incarcerated for far too long. Back in 2008, Justin was convicted of crimes he did not commit, receiving an overwhelming sentence of 45 years to life. This sentence was not only unjust but also legally questionable due to a gang enhancement that was improperly applied. The District Attorney, after the jury had been dismissed, inexplicably requested changes to the jury verdict to a statute that had no bearing on Justin’s case – specifically, codes 246 and 186.22b5. Justin's rightful sentence should have been substantially lower, at 34 years, with the possibility of parole after serving half his time. Yet, he is now four years overdue for his release.
Justin Montgomery has spent his entire young adulthood within the confines of a cell, separated from friends, family, and the life he deserves. His case exemplifies the critical need for judicial accountability and reform.
