I ran for Georgia State House Representative to make a meaningful difference in our community by fighting crime, ensuring justice for victims, and holding rogue district attorneys accountable for failing to prosecute serious crimes.
My name is Elvia Davila, and I am reaching out to share the story of my husband, Juan Carlos Davila Brambila, who was tragically murdered on December 18, 2021, for standing up for his beliefs and courageously standing against violent criminals from Mexico.
Juan Carlos was a proud conservative and understood the dangers this country was facing under the wrong administration. He was a fierce advocate for justice, safety, and accountability. His unwavering stance against the violent influence of criminals made him a target, and our family has been forever changed by his loss.
Now, more than ever, we must take a stand together to demand justice for Juan Carlos and all victims of Terrorists violence. These terrorist organizations cannot be allowed to operate with impunity. Our communities, our families, and our nation deserve safety and justice.

On December 17 2021, my beloved husband Juan Carlos Davila-Brambila and I hosted a nativity reenactment gathering. We hosted our family and friends with children for several hours and the crowd began to disperse but Ernesto Pelayo refused to leave when his wife asked him to and refused our invitation to use a spare room. My husband being a good host did not want to leave him unattended and during the early morning of December 18th Ernesto Pelayo intentionally murdered my husband in front of my own eyes and a second witness. Ernesto left my 3 children fatherless and ripped my other half from me. He used his truck to run him over after Juan Carlos clearly told him 3 times "I appreciate you and don't want to fight you", "Stop I won't fight with you". In 22 years of marriage, he never had an argument or a fight with anyone. Juan Carlos was a very peaceful man. The 2nd witness told him "What else do you want Ernesto? Juan Carlos is telling you he doesn't want to fight." ERNESTO gestured with his hand and insinuated that he had a gun by saying "I've got what is needed". My husband being the host and friend to the 2nd witness did not want him to come to harm for trying to diffuse Ernesto, so he followed them at a distance to make sure that his friend would be okay. Ernesto got in his truck, backed up and instead of leaving swerved onto the curb and into my husband. I remember seeing Juan Carlos hit the hood multiple times with his hand for Ernesto to stop and he did NOT. My husband was not able to hold on and Ernesto ran him over. I screamed at the 2nd witness to pull him out of the street, and I saw how Ernesto put his truck in gear to reverse over my husband nearly running over the 2nd witness as well. This 2nd witness pulled my husband out of the street and tried to protect him between 3 trees so that Ernesto could not continue to ravage him. I ran into the street trying to get to my husband's side and Ernesto lurched forward in his truck I narrowly escaped by jumping out of the way, but he still stopped to yelled at me "I'm done go fuck your mother". I watched with terror as my husband agonized in my arms and I could see the impotence in his eyes because I know that he did not want to die. Ernesto evaded police and began calling relatives to help him evade justice, but 3 days later he was arrested in an abandoned plot of land in Henry County GA. He intentionally killed Juan Carlos after he welcomed him into our home. Juan Carlos my kids and I and the rest of his family deserve justice.
Trial: Ernesto was arraigned, and case #22-B-01077-6 was assigned to Gwinnett ADA Christina Lee who had him Indicted for MALICE MURDER, AGGRIVATED ASSAULT & AGGRIVATED BATTERY and said she needed nothing more than the facts of that case to prosecute Ernesto for those crimes and make sure he would be in jail for a very long time. Several months passed as we waited to be scheduled for trial which was finally set on Sept 12th, 2022. To my utter bewilderment, I received a call from Drew Unger on Sept 8th to introduce himself and notify me that he had been reassigned to the case by orders of Daryl Mans. He then went on to tell me that Christina Lee was inexperienced, was completely mishandling the case, and had indicted the case wrong. He told me that he needed to reindict for FELONY MURDER because it was easier to prove before a jury and made his job much easier. I reluctantly agreed to that because he reassured me that FELONY MURDER carried the same sentencing as MALICE MURDER, he never mentioned that he would be dropping the charges of AGGRIVATED BATTERY. I am discontent with such a drastic change at the last minute, and it is concerning that where Lee was very confident with her case Unger showed incompetence as he began to question me last minute about other people at the gathering and previous incidents with Ernesto. Unger began to tell me that 2 eyewitnesses was not enough to a jury. Alas, Trial was scheduled for Oct 17th, 2022, which never came because on Oct. 13th after a motion hearing, Drew called me and let me know that he had spent the entire afternoon NEGOTIATING without letting us know for a bench trial and that he had decided to reduce the charge of Felony murder to VOLUNTARY MANSLAUGHTER. He said it was a done deal and that we had no other options, and that sentencing was completely up to Judge Ronnie K. Batchelor. Drew told us all we could do was speak to the judge at the bench trial and ask for the sentencing we wanted, and we did on Oct 18th, but Ernesto had entered a guilty plea, so no evidence or testimony was heard. Ronnie K. Batchelor then sentenced Ernesto Pelayo to 5 YRS HOUSE ARREST & 5 YRS PROBATION. On Oct 19th at 12:46 PM Ernesto was unleashed upon the community and immediately started using social media and sending threats towards our family. This bloodless killer continued to drive the truck he used to end my husband's life and kept it as a trophy despite owning other vehicles. He has violated his probation and is currently being held w/o a bond. I want him to face the consequences of his acts. His own children fear him, and their mother has obtained a protective order due to the abuse and terror he has brought on them while my children grieve every day for their father. What will it take for us to get justice? We demand justice and a review of the case by the Supreme Court, and a review of the statement from the prosecutor Drew Unger at bench trial. We believe these and many other inconsistencies are basis for a reviewal. We are not the only family in Gwinnett County suffering the ineptitude of DA Patsy Austin-Gatson. There have been several murder and homicide cases met with impunity since Austin-Gaston took office these are not simply coincidences, luck, or the result of jurors having an appreciation for crime-themed entertainment. Please sign this petition to demand justice for Juan Carlos he was an extraordinary man whose life was precious not just to myself and my children, but to so many more who's life he touched and he deserves justice.
