We, the undersigned, respectfully submit this petition seeking justice and fairness in the case of **Herbert Suggs Jr.** We firmly believe that the legal proceedings surrounding his case have been marred by inconsistencies, loopholes and misunderstandings, leading to an incorrect and unjust ruling.

 

**Case Background:** 

Herbert Suggs Jr. has found himself entangled in a deeply tragic and complex situation involving the mother of his children and her boyfriend, who is also Herbert’s nephew. It has been established that they came to Herbert’s home on the day of the incident with the intent to entice violence. All while Heberts children were present on the scene according to police documents. Their actions were designed to provoke Herbert into a situation where he felt threatened for his life on his own property. There have been a slew of back and forth arguing between Herbert and his nephew over the last few years but never has there been a physical altercation between them until March 13, 2024. Herbert is the uncle of this person.

 

Despite the hostile actions of the other parties involved, Herbert Suggs Jr. now potentially faces the harsh consequences of a system that seems to have overlooked key facts and failed to fully consider the malicious intent behind the events that transpired.

 

**Points of Concern:**

 

1. *Inticiment to Violence:** 

   It is a known fact that Herbert Suggs Jr. did not instigate the conflict. The mother of his two younger children, accompanied by her boyfriend, which is Herbert's biological nephew and Herbert's children all arrived at Herbert's residence with clear intent to provoke and escalate tensions and succeeded. This deliberate incident should be viewed as a critical factor in the case, as it directly contributed to the unfortunate series of events that followed.

 

2. **Lack of Proper Legal Consideration:** 

   The court has seemingly disregarded the motivations and intentions of the parties who came to Herbert’s home. The ruling does not adequately reflect the full context of the situation, including the psychological, emotional, and physical distress Herbert endured during the encounter. Keep in mind, Herbert filed a child protective service report via 1-800 hotline upon his release from jail because upon receiving official police paperwork from his charges, he seen his children's names listen documents as witness on the scene. Days later, he received a call from Christine Sito from the Saratoga County child protective services office telling him to come down to talk to them. Upon arrival, they informed him that my document is fraudulent and that I "penciled" it in. Even though his lawyer, the police department, two different sets of courts, Herbert him self all have the same documents, all matching up besides child protective service. Is Someone his hiding something? If so, it needs to be exposed immediately. CPS threw his report citing that he lied and fraudeltly penciled his children's names in to create a false CPS reports. Officer Ives from the Ballston Spa police department has confirmed that it's definitely not Herbert's handwriting and that in fact it is the arresting  Officer Thorpe's hand writing. Herbert has all documentation and all recordings regarding every single legal proceeding during his tbh is entire process and will furnish anything if necessary.

 

3. **Self-Defense and Protection:** 

   In cases where an individual is provoked in their own home or property, the right to self-defense must be carefully examined. Herbert Suggs Jr. had every reason to believe that his safety was at risk, given the aggression of the individuals who appeared at his doorstep and the speculation of events Herbert considers a "Cold War" between him and several family members. This fundamental right to protect oneself and one's home appears to have been overshadowed by a misinterpretation of events.

 

4. **Injustice in potential Sentencing:** 

   The sentence that wants to be handed down to Herbert Suggs Jr. is disproportionately severe, especially when considering the facts of the case. It is crucial that this miscarriage of justice be corrected to prevent further damage to Herbert and his family, who have already endured so much.

We respectfully request a thorough examination of Herbert Suggs Jr.'s case, with the following considerations in mind:

 

1. A full and thorough review of the evidence, including testimonies and facts regarding the intent and actions of the mother of Herbert's children and her boyfriend. 

2. Consideration of Herbert's right to defend himself and his home and property against those who came to provoke violence.

3. An evaluation of the fairness of the sentence in light of these circumstances, and potential relief in the form of a reduced sentence.
