WE, THE UNDERSIGNED, ASK FOR JUSTICE FOR KYLE
On August 12, 2026, Captain Kyle Lee Huffman lost his life.
Kyle was more than the circumstances surrounding his death.
To his friends, family, colleagues, and community, Kyle was a genuine, generous, kind-hearted man who brought laughter, friendship, and love into the lives of the people around him.
He was loved.
He mattered.
And his death deserves a complete, thorough, and impartial investigation.
We, the undersigned members of Kyle’s family, friends, community, and concerned public, respectfully request that Arkansas authorities fully investigate the conduct and communications preceding Kyle’s death and determine whether sufficient evidence exists to pursue criminal charges under Arkansas law.
WHY WE ARE ASKING FOR AN INVESTIGATION
According to information provided by people close to Kyle and allegations that should be investigated by law enforcement, Kyle had been experiencing significant emotional distress during the period preceding his death.
It is alleged that Kyle reported that his wife, Miranda Huffman, had been involved in an extramarital relationship with Tim Van Dyke.
More importantly for purposes of this petition, witnesses and individuals close to Kyle have alleged that during the months preceding his death, Kyle was subjected to repeated humiliation, insults, belittling, and emotionally harmful communications.
It is further alleged that deeply personal information and insecurities Kyle had shared privately with his wife were disclosed to Tim Van Dyke and subsequently used in communications directed toward Kyle.
According to those close to him, Kyle communicated that he was struggling mentally, asked for the conduct to stop, asked to be left alone, and expressed that he could not take any more.
These allegations have not been adjudicated in a court of law. This petition does not ask the public to determine guilt.
We are asking law enforcement to determine the truth.
THE EVENTS OF AUGUST 12, 2026
We specifically request a thorough investigation of the hours immediately preceding Kyle’s death.
It has been alleged that Kyle was subjected to hours of insulting, belittling, or otherwise emotionally harmful communications or conduct before his death.
It has further been alleged that Kyle died in Miranda Huffman’s presence.
We ask investigators to establish an accurate timeline of those final hours, including:
All communications involving Kyle, Miranda Huffman, and Tim Van Dyke;
Text messages, social-media messages, call logs, voicemails, photographs, videos, and other electronic evidence;
Statements made to or about Kyle immediately before his death;
Whether Kyle communicated suicidal thoughts, intentions, emotional distress, or requests that the communications stop;
What each relevant person knew concerning Kyle’s mental and emotional condition;
What occurred immediately before Kyle’s death;
The timing and sequence of telephone calls following the incident;
When emergency medical assistance and 911 were contacted;
Any communications occurring between witnesses or involved persons before emergency services were contacted; and
Any other evidence bearing upon whether another person’s conduct violated Arkansas criminal law.
We specifically ask investigators to verify the allegation that, immediately following the incident, Miranda Huffman’s first telephone call was to Tim Van Dyke rather than emergency services.
This allegation is significant enough that it should be established or disproved through objective telephone records and the official emergency-response timeline.
ARKANSAS LAW
Arkansas Code § 5-10-107
Encouraging the Suicide of Another Person
Arkansas has specifically criminalized encouraging another person’s suicide.
Under Arkansas Code § 5-10-107, investigators may examine whether a person used persistent spoken or written language for the purpose of encouraging another person to commit suicide and whether the suicide or qualifying suicide attempt occurred as a proximate result of that encouragement.
The statute defines encouragement to include persuading, inciting, or urging another person.
A violation of this statute constitutes a Class D felony.
We therefore respectfully request that investigators determine whether any messages, statements, recordings, electronic communications, witness testimony, or other evidence preceding Kyle’s death satisfy the elements of A.C.A. § 5-10-107.
We are not asking authorities to presume those elements are established.
We are asking authorities to investigate whether they are established by the evidence.
Arkansas Code § 5-71-217
Cyberbullying
Arkansas law also criminalizes certain forms of cyberbullying.
The statute addresses electronic communications transmitted, sent, or posted with the purpose of frightening, coercing, intimidating, threatening, abusing, or harassing another person when the communication furthers severe, repeated, or hostile behavior toward that person.
Accordingly, we request examination and preservation of relevant electronic communications to determine whether any conduct preceding Kyle’s death constitutes cyberbullying under A.C.A. § 5-71-217 or another Arkansas criminal offense.
THE DIGITAL EVIDENCE MATTERS
In a case involving allegations of repeated communications, electronic evidence may provide some of the most objective evidence available.
We respectfully request that investigators take all lawful steps necessary to identify and preserve relevant:
Text Messages • Facebook/Messenger Communications • Social-Media Messages • Emails • Call Logs • Voicemails • Deleted Communications • Photographs • Videos • Cloud-Stored Data • Device Data • Location/Timeline Information • 911 Records • Dispatch Records
We further ask that investigators interview individuals who witnessed relevant conduct or received communications from Kyle concerning what he was experiencing.
PRIOR SIMILAR ALLEGATIONS SHOULD BE PROVIDED TO INVESTIGATORS
Members of the community have reported allegations concerning a previous relationship involving Miranda Huffman in which another individual allegedly experienced a serious mental-health crisis and survived following intervention.
We recognize that an allegation involving another person does not establish guilt concerning Kyle’s death.
However, if that individual has firsthand information that he believes is relevant, we urge him to provide his account and any supporting evidence directly to investigators so law enforcement can determine whether that information is legally relevant or admissible.
WHAT WE ARE ASKING AUTHORITIES TO DO
We respectfully request that the Benton County Prosecuting Attorney, Siloam Springs Police Department, Benton County Sheriff’s Office, and any other appropriate agency:
Conduct a complete and impartial investigation into the circumstances and communications preceding Captain Kyle Lee Huffman’s death.
Preserve and forensically examine relevant electronic evidence through lawful investigative procedures.
Interview all material witnesses with firsthand information.
Establish a complete timeline of Kyle’s final days and hours.
Determine whether the evidence satisfies the elements of Arkansas Code § 5-10-107 — Encouraging the Suicide of Another Person.
Determine whether electronic communications constitute cyberbullying under Arkansas Code § 5-71-217 or another applicable offense.
Evaluate any other Arkansas criminal statute supported by the evidence.
Present legally sufficient evidence to the appropriate prosecuting authority for consideration of charges when warranted.
Keep Kyle’s family appropriately informed regarding the status of the investigation to the extent permitted by Arkansas law.

KYLE’S LIFE MATTERED
Captain Kyle Lee Huffman cannot be reduced to the final moments of his life.
Kyle was a friend.
He was family.
He was loved.
He was someone people could laugh with, depend upon, and remember for the genuine and generous person he was.
His friends, family, and community are grieving an irreplaceable loss.
We cannot change what happened on August 12, 2026.
But we can insist that Kyle’s story be taken seriously.
We can insist that evidence be preserved.
We can insist that witnesses be heard.
We can insist that the circumstances surrounding his death receive a complete investigation.
And we can bring attention to something much larger than one tragedy:
Bullying does not become harmless simply because the victim is an adult.
Emotional abuse can have devastating consequences.
Cyberbullying can have devastating consequences.
Repeatedly targeting a person who is known to be emotionally vulnerable can have devastating consequences.
Our children, teenagers, veterans, first responders, friends, neighbors, mothers, fathers, husbands, wives, and loved ones deserve a society that takes these behaviors seriously.

We sign this petition in memory of Captain Kyle Lee Huffman.
