FACT CHECK: DESPITE LANCE KLAGUES TRYING TO TAKE CREDIT FOR CREATING THIS PETITION IN THE LATESTS ARTICLE HE HAD PUBLISHED AT THE UNIVERSITY OF MONTANA, HE DID NOT CREATE THIS NOR DID ASHLEIGH GERVAIS. LANCE ALSO HAD NO PART IN CONTRIBUTING TO THE COURTNEY KLAGUES SCHOLARSHIP FUND AT THE UNIVERSITY OF MONTANA. ON THS PETITION THE TRUE CREATOR WANTS TO KEEP THINGS FACTUAL, WHICH LANCE HAS FAILED TO DO. WHILE WE ALL WANT JUSTICE FOR COURTNEY, WE ALSO WANT TO KEEP THE TRUTH THE ACTUAL TRUTH.

Courtney Klagues, a 21-year-old University of Montana Political Science student with an emphasis in Pre-Law, was killed by a reckless driver who negligently crashed her Jeep into Rock Creek River with Ms. Klagues in the passenger seat where she was trapped, badly injured, and eventually drowned. Click here to read about the accident. The police report, our family's private forensics accident reconstruction investigators, and a hired physicist all have indicated that Courtney was killed by careless driving. The driver was not arrested, not even given a speeding citation, nor cited for an expired license that was noted in the accident report. The County Attorney, Blaine C. Bradshaw has seen both reports and expressed to our family that he does not intend to press charges against the driver. #JusticeForCourtneyK

Another direct quote from the police report: "Driver Actions at Time of Crash 1 (based on judgment of investigation officer): DROVE IN DISTRACTED, INATTENTIVE OR CARELESS MANNER"

Montana's Negligent and Vehicular Homicide Laws and Penalties:

"If the court establishes that you had no intention whatsoever of causing harm, but you caused the death of another human as a result of being reckless or negligent, then you can be charged with involuntary manslaughter. Ordinary negligence is inattention or driving that lacks the care and prudence that an ordinarily careful person would exercise under the circumstances. For example, a driver who only briefly takes his eyes off of the road while reaching into his car’s console can still be charged with vehicular manslaughter if his inattention results in a fatal accident. If you have caused a car accident as a result of carelessness, then you may be charged with manslaughter, if someone has died as a result of you being negligent. Under Montana’s negligent and vehicular homicide laws, a motorist acts negligently by driving in a manner that poses a risk to others where the motorist consciously disregards or should be, but isn’t, aware of the risk. Causation. A driver can be convicted of negligent or vehicular homicide only if there’s proof that the driver was a legal cause of the death. It’s not enough to merely show the defendant drove negligently and someone died—there needs to be a direct link between the defendant’s driving and the death. (1) A person commits the offense of vehicular manslaughter if the person: (a) operates a vehicle recklessly or carelessly or with gross negligence likely to cause the death of or great bodily harm to another; and (b) the operation of the vehicle results in the killing of a human being ..."

Where is the justice for Courtney, Granite County??? Why has the driver been let off the hook? The FACTS are there.
