The Issue
Maison Callender was just 5-months-old when he lost his life as the result of gross hospital misconduct. Today would be his seventh birthday, and I need your help to urge Governor Kathy Hochul to sign the Grieving Families Act so that no other family endures the suffering my family has.
After being admitted to Cohen Children's Medical Center in 2017, Maison was treated and diagnosed with influenza, and discharged with nothing more than Tamiflu. His last hours were spent in pain and discomfort: at the hospital, nurses and doctors withheld food for approximately 40 hours before he underwent two failed intubations.
Less than 72 hours later, Maison passed away due to complications from sepsis and pneumonia.
What pains me most, is that there is still no accountability from the hospital and doctors who caused his death, because under New York's current wrongful death laws, juries can only consider lost wages (pecuniary damages) in rendering a fair verdict.
As long as the law stands this way, there will be no justice for Maison and the countless other families who have lost loved ones to medical negligence.
Thankfully, the legislature has passed the Grieving Families Act with overwhelming bipartisan support. It is now up to Governor Hochul to right this wrong.
