Justice delayed, Conditional Pardon Overdue

In 2017, Robert Barker was a man in his 40s living a life defined by service, responsibility, and community impact. With no prior criminal history, over 13 years of steady employment, and a lifetime commitment to his family, Robert had long established himself as a dependable father of three and a proud grandfather.

Beyond his family, Robert was deeply rooted in his community across Virginia. For more than a decade, he served as a dedicated youth football coach, mentor, and community volunteer—positively shaping the lives of countless young men. Coaches, teachers, athletic directors, local business owners, and even law enforcement officers have consistently recognized his character, leadership, and integrity.

In late 2017, Robert became involved in a tragic, isolated incident involving a family member experiencing a severe emotional and mental health crisis following a devastating personal loss. During this rapidly unfolding and fearful encounter, Robert was charged with felonious assault, resulting in a non-life-threatening injury.

Court testimony and eyewitness accounts documented that the individual involved exited a vehicle armed and approached Robert’s position at the time of the incident. These facts were presented as part of the official proceedings.

Following sentencing guidelines reviewed by the Virginia State Sentencing Commission, a pre-sentence report recommended a low-end guideline of approximately five years of incarceration. Despite this, Robert was ultimately sentenced to serve a significantly longer term of 20 years, requiring him to serve 85% of that sentence.

Today, after nearly nine years of incarceration, Robert’s family and supporters are respectfully asking for a renewed review of his case. We are requesting consideration from Governor Abigail Spanberger and the Virginia Parole Board for a conditional pardon and early release based on his documented rehabilitation, community support, and the circumstances surrounding his sentencing.

Robert’s impact has not faded with time. The voices advocating for him—spanning 49 states—include those who have worked closely with him in schools, athletic programs, and the community. These are individuals who have stood by his character for years and continue to speak out because they know the man he is.
