Hello. My name is Annette Bryant. Please, I need you to sign this petition. My husband, Terrell Bryant, is illegally incarcerated at the Franklin Medical Center in Columbus, Ohio. At his sentencing in November 2011, he was sentenced to ten years in prison and given an incorrect amount of 210 days of jail-time credit with a release date of April 3, 2021. He had actually been in jail since May 11, 2010, so he was supposed to receive about 539 days of time served with a release date of May 11, 2020. His judge, Franklin County Court of Common Pleas Judge Colleen O'Donnell, has blatantly disobeyed orders from the Ohio Tenth District Court of Appeals and the Ohio Supreme Court to correct this error. Franklin County Prosecutor Ron O'Brien has continuously supported her in doing so.

Terrell has been fighting for the correction of this miscalculation by filing several motions to Judge Colleen M. O'Donnell. She has denied each motion as meritless.  After her final denial in April 2019, Terrell appealed her decision in the Ohio Tenth District Court of Appeals (Case #: 19-AP-0241). On February 4, 2020, the Appellate Court ruled in his favor and reversed and remanded the case back to Judge Colleen O'Donnell to correct the error, but she did not comply. In March 2020, Prosecutor Ron O'Brien filed a case in the Ohio Supreme Court for dismissal of the Appellate Court's ruling (Case #: 2020-0391). On August 5, 2020, the Ohio Supreme Court dismissed the case, agreed with the Appellate Court, and reversed and remanded the case back to Judge Colleen O'Donnell to correct the error. Still, she did not respond or comply. 

My husband finally had a hearing on December 2, 2020. We thought that Judge Colleen O'Donnell was finally going to show a sense of morality and correct the jail-time credit error. Well, at the hearing, Prosecutor Ron O'Brien once again objected and said that Terrell is not entitled to anymore time, even though the Ohio Supreme Court ruled otherwise. After that, my husband's attorney, Attorney James Anzelmo, still had to convince Judge Colleen O'Donnell to review the Appellate Court's ruling. Then, she decided that she would calculate the numbers herself and then decide. In the meantime, Terrell is still illegally incarcerated!

Terrell and I have two sons, one of which is disabled, a daughter, and a grandson, along with his devoted mom, who have all been anxiously awaiting his release. We have been waiting for a long time for him to come home. We miss him dearly. I am ready for my family to be reunited! Terrell has served his time! We want him, and others suffering like him, to be treated fairly and be given the jail-time credit that they deserve. Families and loved ones are hurting! 

Judge Colleen O'Donnell's actions have caused devastation to my husband and our family. Who will hold her accountable for what she has done? She has robbed Terrell of his valuable time, caused him undue stress, and forced him to serve a longer sentence than he was supposed to. Terrell has fulfilled his end of the bargain with the State of Ohio. Where is the justice for not only him, but the others that are illegally incarcerated because of jail-time credit errors? This is not fair at all. How are judges and prosecutors able to get away with treating people like this? Judges are supposed to interpret, enforce, and follow laws, not make their own laws. Prosecutors are supposed to fairly seek justice, not continually punish people and make their own rules. Judges and prosecutors are supposed to be positive examples in society! Who will hold Judge Colleen O’Donnell, Prosecutor Ron O’Brien, and others like them accountable for their inequitable actions?
