We ask the Department of State (DOS), Department of Homeland Security (DHS) and the United Sates Citizenship and Immigration Services (USCIS) to put an end to applying INA212a3B across-the-board to all Iranian men who served compulsory military service in IRGC.

In Iran, compulsory military service is obligatory for male and they are summoned to the service at the age of 18..  Those Men who are not attending this compulsory military service would be rendered obsolete from many social rights such as applying for a passport, being hired,recruited or employed, or even buying a property is quite illegal for those absentees. Importantly ,the military branch and location  is selected randomly by some sorts of lottery or something like that.Every Iranian male  has  to fulfill a 24-month compulsory military service; however, they have no choice or alternative in choosing the military branch or location  they are assigned to, and the assignment is solely imposed to them rather by chance and  may be through a lottery system.

Iran Revolutionary Guard Corps (IRGC) is an official branch of the Iran Armed Forces. In April 2019, IRGC was announced as a terrorist organization by former President of the United States, Donald J Trump. Since then, many individuals are being denied US Visas (immigrant and non-immigrant) because they had  served compulsory military service in IRGC and in many instances it has been years since they had completed their service.

We faced Trump Ban for 4 years and now we are facing another unfair ban called INA212a3B. We have spent 2 years of our golden years of lives to fulfill obligatory military service and now we are faced with visa denials due to INA212a3B. Many fathers are missing to observe their beloved children growing up and others losing the golden opportunity to study in prestigious US institutions or work in the US.  

There are children who are born in the US, yet their fathers have not had the opportunity to see their children since they were born in US. These children know their fathers only through a screen and via virtual media, an image from a phone. Children growing up apart from their fathers, miss the opportunity to grow and benefit from their fathers as their models and may soon forget him. Fathers live with the sorrow to hug their kids and are not able to pour their love on their kids. Spouses (wives) are wishing for building a lovely home and a spirit of family community  . however, the hope is fading away year after year. Parents  are looking forward to having their adult children close to them and enjoying their presence in the last years of life.

Brilliant young men graduated from university and served their compulsory military service in order to enjoy basic civil rights such as holding a passport and being able to travel abroad. These talented people got offer letters from the best US universities to pursue their education and use their beneficial talent to make the world a better place and to help build a better society. Lottery winners who see their lifelong ambitions is coming true to live in the land of dreams, yet they are about to  lose this chance by the unfair President Trump’s decision which has been upheld in President Biden era and yet another group might lose this chance just because of being drafted to IRGC which they had no other alternative. Iranian conscripts (soldiers) are of no difference from that of  a Pawn in the chess board. He has no choice and has been moved similar to a chess Pawn. Why hasn't President Biden’s team who advocates  human rights  shown an interest to solve our problem? Why is it that we have no right to complain, as if we have been sentenced to exile without committing a crime? Why INA212a3B is not being implemented properly?

در کشور ایران سربازی برای مردان بالای هجده سال امری اجباری ست که بدون گذراندن این دوره دوساله از بسیاری از حقوق اجتماعی مثل گرفتن پاسپورت،استخدام و خرید خانه و...محروم میشوند.محل انجام خدمت سربازی با قرعه کشی تعیین میشود.سپاه پاسداران  یک ارگان رسمی در کشور ایران هست که جوانان به قید قرعه باید خدمت سربازی اجباری خود را در این سازمان بگذرانند و در این باره حق انتخابی ندارند.سپاه در اپریل ۲۰۱۹ توسط پرزیدنت ترامپ بعنوان گروه تروریستی اعلام شد.بسیاری از افرادی که از گرفتن ویزا محروم شده اند سالها قبل از آن خدمت سربازی خود را به اتمام رسانده اند.انها ۴سال با بن ترامپ و اکنون با بن غیرمنصفانه ی دیگری بنام 212a3bمواجه هستند .نتیجه آنکه پس از دوسال از دست دادن بهترین فرصتهای کار و تحصیل بدلیل خدمت سربازی اجباری اکنون دارند سالهای طلایی دیگری را بدلیل همان سربازی اما اینبار پشت مرزهای امریکا از دست میدهند.آنها پدرانی هستند که در آرزوی پیوستن به فرزندان خود هستند.پدرانی هستند که فرزندشان در آمریکا متولد شده  ولی هنوز موفق به دیدن اونشده اند.کودکی که پدر را فقط بعنوان یه تصویر متحرک در تبلت میشناسد.فرزندانی که در حال فراموش کردن پدران خود هستند و پدرانی که در حسرت در آغوش گرفتن فرزندان و جاری ساختن عشق انباشته در وجودشان به پای آنها.همسرانی که در آرزوی ساختن آشیانه مشترک و بدنیا آوردن فرزند هستند اما هرسال این امید به یاس نزدیک تر میشود. پدران و مادران از پا افتاده ای که چشم براه فرزندشان هستند تا در سالهای پایانی عمر ازحضورآنها بهره مند شوند. جوانان نخبه ای  هستند که دانشگاه رفته و بعد سربازی خود را گذرانده اند تا حق گرفتن پاسپورت و ادامه ی تحصیل در بهترین دانشگاهها را داشته باشند تا بتوانند از استعداد خداادادیشان برای ساختن جامعه ای بهتر استفاده کنند. برندگان لاتاری که تقدیر بلندشان شانس زندگی در سرزمین فرصت ها را برایشان رقم زده اما عده ی زیادی از آنها با یک تصمیم غیرمنصفانه ی ترامپ این شانس را از دست دادند و عده ی دیگری در دولت پرزیدنت بایدن بدلیل خدمت اجباری در حال از دست دادن شانس مهاجرتشان هستند.سرباز ایرانی با سرباز شطرنج تفاوتی ندارد.او از خود اختیاری ندارد و فقط بعنوان مهره از او استفاده میشود.چرا دولت پرزیدنت بایدن که همواره به حقوق بشر احترام میگذارد توجهی به حقوق این افراد ندارد.چرا حق اعتراض از آنها سلب شده.چرا بدون آنکه جرمی مرتکب شوند غیابا محکوم به گذراندن زندگی خود در تبعید شده اند .چرا بند 212a3bدرست اجرا نمیشود
