Parents right to sue when their adult child dies due to medical negligence.

The Issue

In 2013 my 28 year old daughter passed away due to medical negligence. On Dec. 25th, 2013 I took her to the ER on 2 separate occasions, approximately an hour apart because she was having difficulty breathing, she was sent home both times even though she told them she still was having difficulty. Approximately an hour after the 2nd time she was sent home we had to call for an ambulance, by the time they got her to the hospital which only takes 5 minutes maximum she was comatosed and I was told the EMT'S tried intubating her and the tube went in her esophagus instead of her trachea cutting off all oxygen to her heart and brain for 6 minutes. On Dec. 30, 2013 my daughter was pronounced brain dead. I have contacted several attorneys and have been told in the State of Wisconsin if your child is an adult there is nothing a parent can do. If the child has children or a spouse, they can but not a parent. I researched and found out in the states of Illinois, Minnesota and Indiana a parent can but not Wisconsin. This law needs to be changed. Losing a child is the worst thing a parent can survive and nothing will bring them back but I feel this is very important.
