We, the undersigned residents of the Commonwealth of Pennsylvania, respectfully petition the Office of the Attorney General to initiate a formal investigation into the financial practices and governance of the Fay-Penn Economic Development Council, as well as broader concerns regarding potential misconduct within Fayette County government, including a comprehensive review of activities over the past fifteen (15) years.

Background and Concerns
Fay-Penn Economic Development Council, located at 1040 Eberly Way, Suite 200, Lemont Furnace, PA 15456, operates as a key economic development entity within Fayette County. However, significant concerns have been raised regarding its financial conduct and governance practices.

Specifically, there are allegations that:

  • Loans and financial resources have been distributed to individuals with direct affiliations to Fay-Penn’s board or leadership, raising potential conflicts of interest
    Proper transparency and oversight may not have been consistently maintained in financial decision-making
  • Non-disclosure agreements (NDAs) may have been used in a manner that limits transparency and discourages public accountability
  • In addition, there is growing concern among residents that broader practices within Fayette County government may be contributing to financial instability and placing undue burdens on taxpayers. Allegations of mismanagement, lack of transparency, and potential misuse of authority warrant independent and impartial review.

Request for Action
We respectfully request that the Office of the Attorney General:

  • Conduct a full forensic review of Fay-Penn’s financial transactions over the past fifteen (15) years, including loan issuance and recipient relationships
  • Examine any potential conflicts of interest involving board members, officers, or affiliated parties during this period
  • Investigate the use and enforceability of non-disclosure agreements (NDAs) in matters involving public interest or public funds
  • Determine whether any actions violate Pennsylvania law, ethical standards, or fiduciary responsibilities
  • Expand the investigation, as appropriate, to include potential misconduct or systemic issues within Fayette County government over the same fifteen (15) year period

The people of Pennsylvania deserve transparent, accountable governance and assurance that public and quasi-public institutions are acting in accordance with the law and in the best interests of the public. A thorough review spanning fifteen years will ensure that any patterns of conduct, if present, are properly identified and addressed.
