Sadly, Tarion has refused to provide appropriately redacted technical investigation reports to HVAC expert Dara Bowser, as Mr. Bowser has repeatedly requested of Tarion over a lengthy period of time.
In a recent e-mail to Tarion Vice President Michael Quast, Mr. Bowser said: "....I can only conclude therefore that Tarion has no technical investigation reports which support it’s position that “there is no problem”. In my view, Tarion is in a unique position to undertake research into problems such as this so as improve the quality of housing in Ontario. This kind of research would benefit consumers, builders and the home-building industry in general. By extension therefore, it seems to me that Tarion’s policy with respect to home-building problems such as this is deny and obfuscate, rather than to undertake research which could lead to progressive improvement in the quality of housing in Ontario."
Given this situation, Justice Cunningham has been asked to consider Tarion's handling of these HVAC systems as part of his Tarion Review as a "case study". We look forward to Justice Cunningham's report with his findings and recommendations!
