Tarion's President, Howard Bogach, still has not answered Dara Bowser's July 5, 2015 letter, so yesterday, Dara Bowser wrote to the Chair of Tarion's board of directors, Mark Basciano. It appears that Tarion's position is that these particular HVAC systems comply with the Ontario Building Code (OBC), so Dara Bowser continues to request copies of the test results upon which Tarion is relying (as well as other related documents). In the package sent to Mr. Basciano yesterday, Dara Bowser included recent test results for two homes with these systems: One home's results found that the installed system provides only 64% of the heating capacity required by the OBC and the other home's results found only 71% of the heating capacity required by the OBC. Hopefully Mr. Basciano will provide the requested information to Dara Bowser promptly. On a related note, on Nov. 5, 2015, the Gov't of Ontario announced a review of Tarion. This is a very important initiative! Here are examples of the related media coverage: http://www.thestar.com/news/canada/2015/11/05/ex-judge-to-probe-home-buyer-complaints-on-tarion.html http://www.canadianlawyermag.com/legalfeeds/2967/ontario-appoints-advisor-to-review-tarion.html This probe of Tarion is a significant development, and we are cautiously optimistic that it will produce much needed changes for Ontario's purchasers of newly built homes. Dara Bowser copied the former judge heading up this review of Tarion, the Honourable Douglas Cunningham, on yesterday's letter to Tarion's Mr. Basciano, and also provided Mr. Cunningham with a 40+ page document related to this request for an Inquiry.
