It has been about six months since HVAC expert Dara Bowser made a request for an Inquiry into the lack of enforcement of the Ontario Building Code concerning certain HVAC systems. On July 31, 2015 Minister McMeekin responded to Dara by letter and said: ".After careful consideration of the materials that you prepared, I would like to inform you that I will not be proceeding with an inquiry. I respect the considerable time and thought that you have given to this matter. Accounts such as yours about how the regulatory and enforcement system for new construction plays out on the ground are very helpful, and will help us to improve it."
Dara then wrote to Minister McMeekin on Aug. 13, 2015 and said "..I note that you did not state any reasons for your decision not to proceed with an Inquiry. I would like to request therefore that you share the reasons for your decision not to proceed with an inquiry. Please provide your reply within a reasonable time, that is to say 30 days or less."
It is now Nov. 3, 2015, and Minister McMeekin has not responded to Dara's Aug. 13, 2015 letter. Winter is around the corner, and far too many Ontario families will soon be freezing in a home that does not meet the minimum OBC for their HVAC system. It is important to note that Minister McMeekin did not disagree with Dara about these systems not meeting the OBC.
CPBH hears from consumers across the province regularly who are facing OBC violations in their newly built homes, and many of them are "stuck" with these OBC violations as neither their builder nor the Tarion Warranty Corp. will properly fix them.
Today CPBH launched complaints with both the Ombudsman of Ontario and the Auditor General of Ontario about Minister McMeekin and the Ministry of Municipal Affairs and Housing (MMAH) and the lack of enforcement of the Ontario Building Code.
Now, we are asking for your help in two ways:
1. Please send a short e-mail to both the Office of the Auditor General, and the Office of the Ombudsman of Ontario and ask them to investigate the lack of enforcement of the Ontario Building Code. Here are the e-mail addresses: bonnie.lysyk@auditor.on.ca AND info@ombudsman.on.ca . (CPBH would be appreciative if you would copy us on your e-mails at info@canadiansforproperlybuilthomes.com . A copy of your e-mail helps CPBH monitor what is happening. If you would rather not copy CPBH, that's ok, too.)
2. Please try to find at least two more people who will sign this petition. We need to continue to send requests about the need for an Inquiry into this serious HVAC issue to Minister McMeekin, Premier Wynne, etc. Hopefully Minister McMeekin will change his mind about the Inquiry if people continue to sign this petition.
