At remote trial the local court Judge David Barra threw out this entire petition including photos and comments placed at the bottom as "Hearsay". He accepted photos in another exhibit that show less water volume and a photo of a failed attempt at repair by the property owner. Judgment ruling was 150% against Technotronic Dimensions, even though retaliatory evictions are not permitted by VT law and the property owner began repair attempts on the flooding in March 2023 while no dispute on the lease agreement was filed. The lease was terminated because Technotronic Dimensions complained about
the increased flooding and the plaintiff said during trial he had a right to terminate the repairs and the lease because of the cost involved and the fact its a commercial lease. The property owner did not enter the case as a commercial entity, the store is the commercial entity and is loosing walk in traffic revenue since June of 2023 when the state of Vermont first declared storm flooding disaster conditions and has not canceled the alert. The public image of this business is severely projected in a negative way due to the neglect of the property owner, and will pursue additional damages in a higher court.
Thank you to all who have signed, and also to those who have signed the official court affidavits submitted to trial. The judge threw those customer testimonials out of court as "hearsay" as well, but I promise to not let that deter me from finding proper justice as we head into 2025 in good spirits.
Special thanks the USMC who have supported me above and beyond the call of duty
exceeding my wildest dreams and who continue to prove they are the best people
the US has ever produced. I am proud to have gained attention as an Honorary Marine
during this disaster emergency. SEMPER FI !
