Improve child maintenance for fairness and transparency
The Issue
Petition: Reform Child Maintenance Laws – Stop Unfair Deductions & Arrears Traps
To: UK Government & Parliament
We, the undersigned, demand urgent reform of the child maintenance system to:
1. Introduce a fixed-rate payment per child, regardless of income.
2. Require transparency on how maintenance payments are spent.
3. Base payments on net income (after tax), not gross.
4. Cap excessive payments to prevent financial hardship.
5. Stop unfair arrears accumulation that traps paying parents in debt.
The Problems with the Current System:
1. Unfair Income-Based Calculation
Child maintenance is deducted from gross income before tax, leaving paying parents struggling with high deductions.
No consideration is given for the paying parent’s own living costs, rent, or essential bills.
High earners pay more, even though all children have the same basic needs.
2. No Transparency in Spending
The receiving parent is not required to prove how maintenance payments are used.
Some parents claim additional benefits without declaring maintenance payments, creating an unfair financial imbalance.
Child maintenance should go directly to benefiting the child, not as unregulated income for the other parent.
3. Unaffordable Financial Burden
Paying parents often cannot afford to see their children due to high deductions.
Child maintenance does not consider additional costs (e.g., clothing, food, school trips, transport) that the paying parent covers separately.
Many parents end up dependent on benefits themselves due to excessive deductions.
4. Unfair Arrears System
The Child Maintenance Service (CMS) often miscalculates payments, leading to unfair arrears.
CMS adds penalty fees and interest, increasing debts beyond a parent’s ability to pay.
Some parents lose their driving licenses, passports, or even face imprisonment due to arrears that were not their fault.
Even when payments are made, arrears continue to build up, trapping paying parents in a cycle of debt.
Proposed Solutions:
1. Fixed-Rate Child Maintenance (Like Jobseeker’s Allowance)
A set amount per child, regardless of the paying parent's income.
Ensures fairness and predictability for both parents.
Recognizes that all children’s basic needs are similar, regardless of the paying parent's salary.
2. Spending Transparency
Receiving parents must declare maintenance payments when claiming benefits.
A basic annual report should show how child maintenance funds are spent (e.g., food, housing, education).
Prevents misuse and ensures funds directly benefit the child.
3. Fair Calculation Based on Net Income
Payments should be based on income after tax and essential living costs.
Ensures that the paying parent can afford to live while supporting their children.
4. Cap on Maximum Payments
Introduce an upper limit to prevent excessive financial burden.
Ensures child maintenance is fair and reasonable.
5. End Unfair Arrears Traps
Arrears should not accumulate due to CMS errors.
If arrears are unfairly assigned, they should be written off after 12 months if disputed.
No interest or penalty charges should be applied to maintenance payments.
CMS should not have the power to seize assets without court approval.
Why This Reform is Necessary:
✅ Fairness: No parent should be penalized for earning more while the other parent faces no financial accountability.
✅ Child Welfare: Ensuring both parents have financial stability improves a child’s quality of life.
✅ Encouraging Employment: The current system discourages parents from working harder or earning more.
✅ Preventing Unjust Debt: Parents should not be trapped in an unfair arrears system that leads to lifelong financial ruin.
✅ Economic Benefits: A fairer system allows parents to contribute more to the economy instead of struggling with unfair deductions.
Call to Action:
We demand that the UK Government review and reform child maintenance laws to create a fairer, more transparent, and financially sustainable system.
Sign this petition to bring fairness to child maintenance and stop unfair arrears from destroying lives.
---
Why This Petition is Bulletproof:
Addresses all key issues: Unfair deductions, lack of transparency, financial hardship, and arrears.
Counters common objections: Makes it clear that reform is about fairness, not avoiding responsibility.
Offers practical solutions: Provides a balanced alternative that ensures children are supported while preventing financial abuse of the system.
The current child maintenance laws inadvertently encourage situations where one parent, typically the mother, might restrict the other parent's access to the child, knowing it will result in an increased financial obligation. It is crucial to address and amend these laws to ensure they serve the best interests of the child and promote a fair and balanced approach for both parents.
