Implementation of Abortion Rights in the Philippines

The Issue

We respectfully submit this petition to urgently call for the legalization of abortion in the Philippines in cases where pregnancy results from rape and child marriage, particularly involving minors. Every year, girls and women are forced to carry pregnancies that are the direct result of sexual violence and coercion. Rape and child marriage are serious violations of human rights, and compelling survivors to continue these pregnancies only deepens their trauma and suffering.

Children who become pregnant are not physically, emotionally, or mentally prepared for childbirth. Pregnancy among minors carries severe health risks, including life-threatening complications, permanent injury, and long-term psychological harm. Forcing a child to give birth is not an act of protection; it is an act that endangers her life and well-being.

Survivors of rape should not be punished for crimes committed against them. Forcing a woman or a child to carry an unwanted pregnancy violates bodily autonomy, prolongs trauma, and strips survivors of dignity and choice. It places the burden of violence on the victim instead of holding perpetrators fully accountable.

Despite the total criminalization of abortion in the Philippines, abortions continue to occur in unsafe and unregulated conditions, resulting in preventable deaths and serious medical complications, especially among poor and marginalized women. Legalizing abortion in limited and clearly defined cases such as rape and child marriage will save lives, reduce unsafe practices, and allow survivors to access proper medical care, counseling, and support.

The Philippine Constitution and international human rights agreements recognize the rights to life, health, dignity, and freedom from cruel and degrading treatment. Forcing survivors of sexual violence to carry pregnancies against their will contradicts these principles and undermines our commitment to protect the most vulnerable members of society.

This petition does not seek to promote abortion as a general practice. It seeks justice, compassion, and protection for survivors of rape and child marriage. No child should be forced into motherhood. No woman should be compelled to continue a pregnancy born of violence.

We urgently call on lawmakers and authorities to amend existing laws to legalize abortion in cases of rape and child marriage, ensure access to safe and confidential medical services, provide psychological and social support for survivors, and strengthen efforts to prevent sexual violence and protect children.

Justice requires that we listen to survivors. Humanity requires that we protect them. We urge our leaders to act with courage, compassion, and respect for human dignity.
