PREAMBLE:
In the case No. W.P.(C).9679/2016, SBI Vs Pensioners, the Hon’ble Delhi High Court passed an order on 13.4.2023. The Additional Solicitor General of India had informed the court that “ in case a representation is given by the petitioners , the competent authority of the Ministry of Finance shall examine the same.”
In accordence to the above court direction, a representation was submitted by the Group of Pensioners (GOP) being the main petitioners in the above case.
Responding to the above, the Government (DFS/MOF) ON ITS OWN has constituted a Committee to submit its report by 21 07 2023

In fact, The above Delhi High court direction is very much similar to the one ordered on 20 01 2022 by the Supreme Court in Late MC Singla's case following our personal representation made to Sri NV Ramana garu the then CJI during Hislordship's visit to Vijayawada on 25 12 2021

ANTICIDENTS:
A committed & formidable GROUP OF PENSIONERS (GOP) took lead to file the case in the DELHI HIGH COURT as envisaged by the late legend leader Com. PPR UPADHYAY GARU (Mysore) represented by Com. Umesh Sharmaji (retd DGM Delhi), an activist who has been well known for his committed spirit for the pendioners' cause in SBI.
Ultimately to our good fortune, The Hon'ble Bench of Delhi High Court paved a CLEAR WAY for constitutung a committe by GOI (DFS/MOF) on SBI Pensioners issues With a time-bound compliance by 21 07 2023.

Role of Federation of SBI Pensioners’ Association ( FSBIPA) in SBI Pension matters

In of the Retd Officers Group, two Members put out a post that it would have been advisable to have a Rep of the Unions which were fighting the Pension Case in the Court on the Committee formed by the GOI.
I reproduce below, for your information, the response posted by me on the Group:-
“The relief claimed by SBI Pensioners’ Federation was limited to uniform rate of pension @ 50% of last pay drawn. Incidentally, it would be recalled that the 40-50% differentiation came about only because the serving Officers’
Federation readily agreed to the differentiation because all that mattered to them was their “constituency” — up to Scale III.
“Reliefs like revision of Family Pension, periodical upgradation of Pension & �% DA neutralisation relief to those who retired prior to 2005 were not there at all.
“Some of the principal Office bearers at the helm of affairs in the serving Officers’ Federation at that time are now in the Pensioners’ Federation also as key office bearers. Can anything be expected of these people!
“It’s only because of Late PPR Upadhyaya, who gathered around a Group of Pensioners (GOP) —- who had no links with the Pensioners’ Federation —- to file a Writ Petition claiming relief on all counts. And without making GOI a party to the case as there was a strong arguable case that the Bank itself had the powers to take a view on the issues raised, as per the provisions of the SBI Act & Regulations.
“The Pensioners’ Federation on the other hand had made the GOI a party to the case.
That’s how the case has dragged on for so long with the Federation & GOI seeking frequent adjournments.
“The first success for the GOP was revision in the rate of Family Pension without any ceiling.
“It must be noted that because the GOI was dragging its feet without letting it be known to the Court what its stand was in the WPs before the Court, the Court ordered that the Petitioners submit representations to the Bank as to their respective stand to enable the Bank to apprise the GoI its comments & recommendations on the representations.
Thereafter, the Court directed the GOI to make its stand clear before the Court, failing which the Court would decide the matter even without the GOI spelling out its stand on the reliefs claimed in the WP of the GOP.
“It’s in this context that the Committee has been formed.
Even if the GOI’s submissions before the Court (based on the Committee’s views) are not favourable, there’s nothing preventing the Court from ruling otherwise on the basis of prevailing law, provisions of the SBI Act & principles of equity.
“Besides Late Mr Upadhyaya, Umesh Sharma based in Meerut has put in tremendous effort in fighting this case & bringing it to this stage. He relentlessly sought voluntary contributions from Pensioners & in the process mobilised substantial funds to fight this case.
“Incidentally, Umesh Sharma was DGM Varanasi ZO at one time. His parent Circle is Delhi.
“In my view, it would be disastrous to involve Reps of Pensioners’ Federation.”
