 Com. C N Venu gopalan has been one among the leading crusaders against injustice to the lamenting Bank Pensioners. MY HEARTY GREETINGS TO COM. " CNV "

 Though the Kerala High Court "fell short of issuing a clean direction"  as rihtly observed by com. Venugopalan himself,the judgment gives a clear cut direction in support of our collective cause.

THUS, THIS JUDGMENT IS OF IMMENCE UTILITY TO FLE A BEFITTING COUNTER  TO THE ILL-CONCEIVED IBA'S AFFIDAVIT DATED    24 08 2022 IN  COM. LATE MC SINGLA'S   CASE   ON    22 09 2022

There is a time for things to evolve and it will happen at that moment only.

Though Court fell short of issuing a clean direction, has ordained that the second respondent SHALL consider the detailed representation of the petitioner and pass appropriate orders in two months taking a liberal view and without a constricted view.

The Court has also made known  the significance of regulation 35.1 and regulation 56 in unambigous terms and accepted the submission of our Counsel  that pension in RBI having been updated, similar updating is to be done in banks also.

In case bank goes in appeal, based on the findings of the single judge, it will be dismissed.

 If we seek a review of the ruling for s clear direction, it may be turned down. If we go in for appeal, division bench may direct us to comply with the directions in the order first and to come afterwards. 

 The only option therefore is to wait for the two months and thereafter to approach the same court and judge through the same petition by filing an IA.

 Anyhow, regulations 35.1 and 56 having been interpreted and adjudicated in a proper and beneficial way the ruling will be of help in the M C Singla case and a favourable decision can emerge there to take the matter to s finality.

 AIBEA, the so called  major union was demanding provisions in the Pension Regulations  for updating pension.
  
Some of our fraternity had doubts and we're maintaining a view that regulation 35 .1 and regulation 56 are of no aid in the matter of updating and C N Venugopalan was misleading all.

They  cannot be right as he was not at all a leader and not leading anyone, but simply interpreting the regulations openly and threadbare for information of those concerned.

It is hoped that such people will not now say that the High Court of Kerala erred in finding that these regulations purport updating

Let us suppose that nothing above works.  In such a situation, the petitions given to the Committee of Petitions in Rajya Sabha and Lok Sabha are there and they are to be disposed.

Thse petitions can clear the isssues well. Hence there is no room for any disappointment.
